RECOMMENDED ACTION: City Council adopt Resolution No. 380 approving settlement of workers' compensation claim. ITEM EXPLANATION: Police Lieutenant JAMES R. HAWKS has submitted medical opinions which support his claim of a work related disability,hypertension. His claim is further supported by opinions resulting from an examination by a city employed doctor. If the city stipulates to a 10% disability rating, the cost for settlement will be $6,532.50. If the city were to contest the case and go to trial at the Workers' Compensation Appeals Board, the costs would be more than $6,532.50. It is recommended by the city's workers' compensation administra- tor and attorney that thecity stipulate to the 10% disability rating for. Lieutenant HAWKS. The attached resolution is forwarded for council consideration. FISCAL IMPACT: Funds are available in the city's workers' compensation reserve to pay this settlement. HAWKS. A STIPULATIO'N FOR AWARD FOR A WORKERS' --__I_-- WHEREAS, the City Council has established and clearly defined its authority to settle workers' compensation claims in excess of five thousand dollars ($5,000); and WHEREAS, the claim of JAMES R. HAWKS is approximately $6,532.50; and WHEREAS, the City Council authorizes a settlement in that amount; NOW, THEREFORE, BE IT RESOLVED by the City Council for the City of Carlsbad, California, as follows: 1. That the above recitations are true and correct. 2. That the City Council authorizes and directs the City Manager to obtain a stipulation in the workers' compensation case of JAMES R. HAWKS in the amount stated.
