RECOMMENDED ACTION:
That City Council oppose AB 3683 requir111g local governments
contracting public works projects to have a labor compliance
program and that notification of that position be given to the
appropriate committee members of the Assembly Ways and Means
Committee.
ITEM EXPLANATION:
This bill represents a m~jor co~t to locai government because it
would require the establishment of contract compliance programs to
assure the following:
1. Weekly certified payroll records from Contractors and Sub-
contractors.
2. Review of said records by the local government agency.
3. Job inspections by the awarding agency to verify payroll
records and compliance with labor law requirements.
4. Withholding of contract payments for unpaid wages and
penalties.
Fl SCAL IMPACT:
Contract administration time required would be theoretically
tripled. The time and manpower requirements for both the
Contractors and the local government agency would create incurred
cost and lower yield per dollar on pubiic works projects.

Suggest Carlsbad oppose the referenced legislation. We
do generally comply with the first two provisions of the
proposed bill. The last four provisions would present
quite a burden and would probably triple the time
presently spent in contract administration.
The increased a~tivity required of the contractor and
the city would result in accelerated deterioration of
the amount of public works facility we will get for our
public works dollar.
