Pm RECOMMENDED ACTION: It is recommended that the City Council UPHOLD the Planning Commis decision to DENY CT 84-2/CP-270, and direct the City Attorney to prepare tl appropriate do cur ITEM EXPLANATION This item is an appeal of a Planning Cmission denial of a 48 unit ten1 tract map and condominium permit. The Foject is located on the nod corner of Alga Road and El E'uerte Street. The site is designated a (Residential-Medium High; 10-20 du's/acre) and the project's density WL 16.9 dwelling units per acre which is towards the high end of this range. The Planning Commission denied this request because they believed the pro. proposed density of 16.9 du's/acre could not be justified. Their rr included, first, the project was not imaginatively designed and was not integrated with the site's constraints. Second, the project did not pr significant on-site amenities over and above the minimum standards o Planned Development Ordinance to warrant an increase in the density. I. RECOMMENDATION It is recommended that the Planning Commission APPROVE the Negative Declaration issued by the Land Use Planning Manager an ADOPT Resolution No. 2265 APPROVING CT 84-2/CP-270 based on the findings and subject to the conditions contained therein. 11. PROJECT DESCRIPTION The applicant is requesting approval of a 48 unit tentative tra map and condominium permit located as described above. The project will be located on a 2.84 acre site and have a density 76.9 du/acre. This density is consistent with the general plar designation of 10-20 du/ac for this site. The subject properti consists of four previously graded parcels that are presently with condominiums. The properties to the north and west are vacant, but have been designated for development at a similar density . The project would consist of six two story buildings, none of which will exceed 35' in height. Each of the proposed buildins would have eight two bedroom units. The units would have a flc area of 1000 square feet. 111. ANALY S IS Planning Issues 1) Does the project conform with the development standards an( covered with weeds. The property to the east is being develope design criteria of the Planned Development Ordinance? ? e e Discussion Development Standards As proposed this project conforms with all the development standards of the Planned Development Ordinance. Each unit woul have a one car garage and one uncovered parking space located within 150 feet of the unit. The required storage would be provided in storage closets located adjacent to the decks and patios. All of the guest parking would be provided adjacent tc the entrance to the project. The common recreation area is proposed as a swimming pool, dech spa, barbeque area, and cabana with restroom facilities. In addition, each unit would have either a private patio or privat deck . All other development standards of the Planned Development Ordinance are met by this project. Design Criteria As proposed, this project also conforms with the design criterj of the Planned Development Ordinance. A pedestrian system woul link the units to the garages and common recreation area. The common recreation area would be centrally located and readily accessible to all of the units. Stamped concrete and landscape islands would be used to breakuE the appearance of the driveway. Trellis structures would be constructed over pedestrian walkways adjacent to garages. All the crib walls proposed to maintain the existing slopes would k heavily landscaped to soften their appearance. Special attentj would be given to the landscaping of the slope adjacent to Algz Road. The Commission should also be aware that the applicant is requesting a variance to the City of Carlsbad's Engineering Design Criteria. The City's criteria for Alga Road requires a 10 foot right-of-way behind the face of curb. The applicant i: requesting a variance to reduce the right-of-way width to 5.5 feet from the face of the curb. This would allow for the construction of a wrought iron fence with wood posts at the bac of the sidewalk. After discussing this request with the Engineering Department i the Utilities and Maintenance Department staff believes that tk can support this request. Utilities and Maintenance has inforr underground behind the edge of the sidewalk. If at some futurc date it did become necessary to locate public facilities in th: area the proposed fence will be constructed in sections that could be easily removed to facilitate access. staff that few if any public facilities would have to be placec -2- W e In addition, the requested variance will have no adverse visual impacts on Alga Road. In conclusion staff believes the proposed project is compatible with the development standards and design criteria of the Planned Development Ordinanace and that the requested variance will have no adverse impacts. Therefore, staff recommends approval of CT 84-2/CP-270. IV. ENVIRONMENTAL DOCUMENTS The Land Use Planning Manager has determined that this project will not have a significant effect on the environment and, therefore, has issued a Negative Declaration on March 12, 1984. We have lived at that address since approximately April, 1979. Our home is one block west of the building site which is the subject matter of the above referenced hearing. My family and I, like my neighbors, have become increasingly alarmed by the number of units being crammed onto lots in the area, with no apparent thought to feasi- bility and future planning for the area. Numerous single family residences are presently vacant in the area and in various stages of dilapidation. Despite the large number of vacant units, real estate owners (and, I suspect, speculators) are filling the lots south of Saint Elizabeth Seton Church on El Fuerte with condominiums. The neighborhood concerns, as you have now surmised, are that our elected officials, without our input, may allow the immediate area to be saturated with so many units per lot that visitors and vacationers from the East Coast, on their way to the Far East, will mistake our community on the hill for Hong Kong. > Planning Commission Re: La Costa Pointe April 4, 1984 Page Two I am not anti-growth. I do not believe my neighbors are anti-growth. aware there were a large number of lots on Unicornio Street that were zoned for multi-family residences. I am pleased that they are being developed. I am aware the developers are not developing for any philanthropic purpose. They embarked on a venture to make a profit. When I moved into the area I was The fact still remains that the "California Gold Rush" of the early 1970s ended with the recession of the late 1970s. Existing homeowners felt and continue to feel the effects of that in the form of: (a) high interest pay- ments on loans taken out to purchase their property, (b) much slower appreciation in real property values, (c) de- preciation of their property by the inability to fill existing units and the unwillingness of those owners of vacant existing structures (many of whom are real estate owning lenders by virtue of nonjudicial foreclosure sale) to keep the units repaired and presentable, and (d) setbacks of months, possibly years, in the non-residential development of the area, such as schools and parks. The bottom line is that existing owners have suffered the same as the faceless general and limited part- nerships who have made and continue to make the land loan payments while they hold the vacant lots on Unicornio Street waiting for the economic environment to change. Many of the speculators may have needed the losses for tax purposes due to their early successful developments of the 1970s. Such is not the case with the residents. This is our home and, in many instances, our only economic investment of significance. The last thing I and my neighbors want you to approve is the cramming of as many units as possible on Unicornio Street, so the partnerships and/or corporate developers can recoup lost profits in order for their principals to afford their dream houses in Rancho Santa Fe and La Jolla. Planning Commission Re: La Costa Pointe April 4, 1984 Page Three We do not need the boats, RVs and second autos parked in the streets, nor the commensurate safety problems they cause for our children. To date, the units being built at the south and west end of Unicornio Street have been relatively reasonable in size and number per lot. The eyesore and problem child has been the units on the north and west end of Unicornio Street and Cacatua Street. We want no more like it. Forty-eight units for this applicant is twenty- eight more than there should be. We urge you not to approve forty-eight units for the above referenced La Costa Pointe site. I encourage you, prior to the hearing on April 11, 1984, to come talk to my neighbors and see the number of condominium units being placed per lot in the area. I have attached the two letters I wrote in con- nection with the Planning Commission hearings. Following hearing and rejection by the Planning Commission, I met with a principal of La Costa Pointe. They had refused to meet with us prior to the Commision hearings sure that their project would be crammed-down our throats. At my meeting with Mr. Gabriel, he emphasized that La Costa Pointe would be a quality project. When I addressed the homeowners concerns about filling the lots with so many units his response was that they could not build larger units and "compete". He threatened to resort to apartments if La Costa Pointe did not get what they wanted. They are back again, this time with counsel who will attempt to point out the errors in the Commissions findings; I will not be available to offer rebuttal. Unlike counsel for La Costa Pointe, I do not appear to advocate a position for a fee. I, like the rest of the homeowners on Cacatua Street, have a vested interest in seeing who our immediate neighbors are. La Costa Pointe, on the other hand, has an interest only in maximizing their profit and moving on to the next community. ,. _- City Council, City of Carlsbad ' Re: La Costa Pointe June 4, 1984 Page Two Regardless of the arguments of La Costa Pointe, the Appeal should be denied: 1. The Planning Commission exercises broad discretion when it rules on the number of dwelling units within a range. That discretion should not be overturned except upon a clear showing of abuse. Orinda Homeowners Committee v. Board of Supervisors (1970) 11 Cal.App. 3d 768,776. La Costa Pointe offered a project (a) at the upper range of density, (b) on a block immediately adjacent to single family residences and (c) much smaller than those units already existing on the same side of the street. The Commission had every right to say no. - 2. Most, if not all, of the homeowners opposing this project haved owned their property for a considerably longer period of time then La Costa Pointe. We lived and continue to live with high interest rates. La Coasta Pointe, regardless of the long range effects on our property values and the safety of our children, will build their "rental units" and take their money bacK to La Jolla and the community to live with the risks of the boats, R.V.'s and motorcycles in the streets and the absent landlords, who have little or no interest in a homeowners association. 3. We are not saying to this Council that La Costa Pointe does not belong in the area. We are saying that 48 units on four lots do not belong on the street closest to large single family residences. The density change should be gradual. The residents on Cacatua Street are entitled to have as much assurance as possible that they will have permanent neighbors who have the same pride of ownership. La Costa Point so much as admitted in filling out the Enviromental Impact Assessment Form, dated December 22, 1983, and signed by Richard G. Grabhorn that they could care less who we get as neighbors: 'I 4 . . . The units are expected to rent at a rate of $650.00 per month . . .I1 City Council, City of Carlsbad ' Re: La Costa Pointe June 4, 1984 Page Three After all the rhetoric from both sides the bottom line is that the Planning Commission's decision not to approve La Costa Pointe is entitled to be upheld. They listened to the voice of the community and their decision supported our view. The Council should not treat that decision lightly. La Costa Pointe is perfectly capable of redesigning their project so as to provide assurance that we will have permanent neighbors who care. Their argument that they cannot do so and compete in the market place is a risk they ran as we did when we bought our homes. P JG/mp , -.
