I ITEMExPLANATIoN This item is an amendment to the Specific Plan for the Car Country Center to clarify sign reguirenk3nts. Presently, the sign standards for this center are vaguely worded and have required mch interpretation by the Land Use Planning Office. This amendment would essentially incorporate the existing sign regulations of the C-2 zone into the specific plan. Also, this amendment muld ~ provide for two freestanding signs on one lot by conditional use permit if more than two dealerships are located on that lot. A conditional use permit could only be granted if certain regulations are met. These regulations include: a) A maximum sign height of 20 feet; b) A 50' setback from interior woperty lines; and c) Aminimum spacing requirement between signs of 200 feet. The Planning Conmission found that this amendment was consistent with the wals and intent of the Car Country Specific Plan and with the City's Sign Ordinance. Through staff review and Planning Cmission hearing, all issues on this matter have been satisfactorily resolved. ENVIFDWlENTALFUWIEW The Land Use Planning Manager has determined that this project is categorically exempt from the City's Environmental Protection Ordinance. APPLICANT: CITY OF CARLSBAD CASE NO.: SP-19(A) WHEREAS, the City Council of the City of Carlsbad, California, has reviewed and considered a specific plan amendment for the regulation of signing in the Car Country Specific Plan; and WHEREAS, after procedures in accordance with the requirements of law the City Council has determined that the publit interest indicates that said amended plan be approved. APPLICANT: CITY OF CARLSBAD CASE NO: SP-19(A) WHEREAS, a verified application for certain property, to wit: Lots 1-11, Carlsbad Tract No. 72-3, Map 7492, has been filed with the City of Carlsbad, and referred to the Planning Commission: and WHEREAS, said verified application constitutes a request as provided by Ti,tle 21 of the Carlsbad Municipal Code; and WHEREAS, the Planning Commission did, on the 11th day of April, 1984 and on the 9th day of May, 1984, hold a duly noticed public hearing as prescribed by law, to consider said request; and WHEREAS, at said public hearing, upon hearing and consider- ing all testimony and arguments, if anyl of all persons desiring to be heard, said Commission considered all factors relating to the Specific Plan; and NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning Commis- sion as follows: A) That the foregoing recitations are true and correct. The development of the Car Country Specific Plan shall be subject to the restrictions and limitations set forth herein which are in addition to all of the requirements, limitations and restrictions of all municipal ordinances and State and Federal statutes now in force, or which hereafter may be in force for the purpose of preserving the residential characteristics of adjacent properties. All public improvements shall be made in conformity with the Subdivision Ordinance and other City standards to the satisfaction of the City Engineer, without cost to the City of Carlsbad, and free of all liens and encumbrances. All land and/or easements required by this ordinance shall be granted to the City of Carlsbad without cost to the City and free of all liens and encumbrances. That specific plans of development in the form of a Planning Commission Determination shall be submitted to the City of Carlsbad prior to the construction of- any phase of the proposed automobile center. That all lighting fixtures shall be a metallic vapor and quartz variety (no flourescent arm-type fixtures) and subject to strict architectural control. All on-site lighting shall be shielded from direct glare onto the adjoining roadways. That a lo-foot landscaped easement shall be constructed along each side of the public right-of-way. Maintenance programs for the subject right-of-way shall be subject to approval of the Parks and Recreation Director. 6 That a minimum of 5 percent of all on-site paved areas shall be landscaped. Design and maintenance of which shall be subject to approval by Parks and Recreation Director. I. RECOMMENDATION It is re commended that the Planning Commission ADOPT Resolution No. 2274 , recommending APPROVAL of SP-19(A), bazn the findings and subject to the conditions contained therein. STAFF REPORT . II. PROJECT REQUEST AND BACKGROUND In 1972, the City Council approved Specific Plan 19 to implement development standards for the 50-acre Car Country automobile center. Included within these standards was a condition providing for one freestanding, freeway-oriented sign. The type of on-site signs permitted was not specifically described or enumerated, but it was stipulated that signs should not exceed the requirements set forth in the Sign Ordinance. Over the years, this has been interpreted to mean that because Car Country is in a C-2 zone, each lot would be permitted one freestanding sign. In those instances where two dealerships share one lot, a conditional use permit was approved to allow one sign for each dealership. Staff has recently received two requests for conditional use permits to allow additional freestanding signs at Car Country. Upon reviewing both projects, staff realized Specific Plan 19 was unclear and that it would be appropriate to clarify the sign regulations at this location by initiating an amendment to the specific plan. . III. ANALYSIS Planning Issues 1) Will the proposed amendment ensure compliance with the intent and guidelines of the specific plan? Discussion Staff is requesting this amendment to clarify the sign regulations at Car Country. At present, the regulations are not specific and open to interpretation. Staff's intent is to make the regulations consistent with what is permitted by the Zoning Ordinance for any C-2 zoned area. In the future, signs would be categorized into those permitted by right and those permitted by conditional use permit. Staff believes the proposed amendment will provide clear and precise guidelines for sign regulation at Car Country and, therefore, recommends approval of this amendment. IV. ENVIRONMENTAL REVIEW The Land Use Planning Manager has determined that this project is categorically exempt from the Environmental Protection Ordinance, Section 19.04.090(5). Attachments 1. The owners of Don Sharpe Porsche and Audi Inc. have requested a minor modification to their approved site plan to add two building expansions increasing building areas by 500 and 750 square feet plus the additions of two roof structures over the existing service areas. Staff has approved this request as a minor change to SP-19 as there is no change in the parking requirements and also no ser- vice areas would be visible from the street. Exterior elevations of the enclosure are consistent with the existing architecture. Staff will present detached site and elevation plans at the Plan- ning Commission hearing. This is an informational item for the Planning Commission and no action is required. If the Planning Commission believes that this request is not minor in nature, the Commission may wish to direct the applicant to submit an amendment to the specific plan.
