CITY Ad CITY MGR. * RECOMMENDED ACTION: That the City Council introduce Ordinance No. nKt increasing the deposit for Political carn?aiqn signs from $100 to $200 and adopt Resolution No. 7,555 settinq the fee for a campaign sign permit at $14. ITEM EXPLANATION At its June 19, 1984 meetinq the City Council directed the City Attorney’s office to raise the deposit for a campaign siqn permit from $100 to $200. This ordinance accomplishes that request. Attached to the aTenda bill is a memorandum from the Director of Building and Planninu which indicates that the $200 c?eposit does not exceed the average cost of removal of campaign signs after the conclusion of a campaiqn. If the actual cost of removal is less than the $200 deposit the difference will. be refunded to the person posting the deposit. Also, the memo- randum suqcrests a permit fee of $14. Resolution No. 76 establishes that fee. The City Council of the City of Carlsbad, California CARLSBAD, CALIFORNIA AMENDING TITLE 21, CHAPTER does ordain as follows: SECTION 1 : That title 21, Chapter 21.41 of the Carlsbad Municipal Code is amended by the amendment of Section 21.41.160(d) to replace the term "one hundred dollars "with the term "two hundred dollars" in the first sentence thereof. EFFECTIVE DATE: This ordinance shall be effective thirty days after its adoption, and the City Clerk shall certify to the adoption of this ordinance and cause it to be published at least once in the Carlsbad Journal within fifteen days after its adoption. Pursuant to Carlsbad Municipal Code Section 21.41.160 Council of the City of Carlsbad hereby resolves that Resolution No. 7515 is amended to establish the permit fee for campaiqn signs at $14.00. FROM: Mar l#*Grector, Building and Planning SUBJECT: Campaign Sign Ordinance The Campaign Sign Ordinance underwent its initial test during the June 5th primary’election. As per Municipal Code, letters and campaign sign permit applications were sent to local, state and national candidates in May to advise them of the Carlsbad political sign requirements. One requirement asked each candidate or a designated committee official to complete a campaign sign permit and pay a $100 deposit. Of the seven candidates who posted campaign signs in the City, only two candidates complied with the requirements of the campaign ordinance by obtaining campaign sign permits and paying the $100 sign removal deposit; however, virtually all signs were removed shortly after the election. A further observation was that the $100 sign removal deposit is insufficient, slnce, under a worse case scenario, it is estimated that it would cost approximately $200 per day for an individual and one vehicle to remove campaign signs in the event that the permittee failed to remove them. The following is a brief synopsis of our experience: Municipal Code number 21.41.160, paragraph (c) sets forth the requirement for the City to charge a fee’to defray the costs of issuing campaign sign permits, with the fee to be established by City Council resolution. the June primaries, no fees were charged since the City did not have sufficient experience to determine an appropriate fee; however, after a During 3 review of (1) research time to establish a list of candidates to receive notifications, (2) the time and expense involved in letter preparation and mailing, (3) permit processing costs, and (4) the expenses involved in monitoring the requirements of the campaign sign ordinance, the average cost came to $14.00.
