RECOMMENDED ACTION:
Approve amended final map of Carlsbad Tract 83-16, Units 1 a
Adopt Resolution No.7450 accepting dedication of a street
reservation on Sombrosa Street, as shown on Rancho Del Ponde
Unit No. 5, Map 8363.
ITEM EXPLANATION:
Engineering staff has completed checking the amended final IT
Carlsbad Tract 83-16, Units 1 and 2; a 170-lot residential p
located north of Olivenhain Road and northwesterly of Rancho
Fe Road, for conformance with the Subdivision Map Act and th
the Conditions of Approval and the tentative map as approved
Planning Commission on August 24, 1983, per Planning Commiss
Resolution No. 2169.
These maps were initially approved by the City Council on Fe
21, 1984. The Subdivision Map Act and the Carlsad Municipal
allows for an amended map to be filed to accomplish correcti
changes to a final map. The amended maps were filed to corr items that were either in error or omitted on the recorded m
to change the location of lot lines.
As part of the final map for Rancho Del Ponderosa, a portion 393 was offered and rejected for street purposes. To connec'
Sombrosa Street from Rancho Del Ponderosa to Santa Fe Ridge,
street reservation must be accepted by the City. The Subdiv
Map Act states that a rejected offer may be accepted by the 1
a later date.
FISCAL IMPACT:
The Developer has signed an agreement to pay 2% of the propo:
building valuation to provide future public facilities. As 1
the original maps, land was dedicated to the City of Carlsbar
instead of Park-in-Lieu Fees.

RESOLUTION NO. 765.0
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF CARLSBAD, CALIFORNIA, ACCEPTING A STREET RESERVATION OF SOMBROSA STREET OVER A PORTION OF LOT 393 OF NAP 8363.
WHEREAS, a portion of Lot 393 of Map 8363 was offerec
public street purposes and rejected by the City Council; ai
WHEREAS, Section 66477.2 of the Subdivision Map Act s'
that a rejected Offer of Dedication shall remain open and
the legislature body may by resolution at any later date ri
its action and accept and open said street; and
WHEREAS, the City Council of the City of Carlsbad has
determined it to be in the public interest to accept said
rejected offer;
NOW, THEREFORE, BE IT RESOLVED by the City of Carlsba
California, as follows:
1. That the above recitations are true and correct.
2. That the Council rescinds its previous action re
the portion of Sombrosa Street as shown on Map 8363.
3. That the rejected Offer of Dedication of a porti
Lot 393 of Map 8363, reserved for street purposes, is here
accepted.

4. That the City Clerk is hereby authorized to caus
Certificate of Acceptance to be recorded in the Office of
County Recorder of San Diego County, State of California.
