(PD) ORDINANCES.
ZCA-173 - CITY OF CARLSBAD
The Planning Cmission and staff are reconmending that the City mcil
introduce Ordinance No. 9 71 7 , amending the Residential and Non-Residential
PD Ordinances.
ITEM EXPLANATION
ZCA-173 wuld make minor changes to Chapter 21.45, the Planned Developnent Ordinance (PD) , and Chapter 21.47, the Non-Residential Planned Developnent
Ordinance (NRPD). The proposed mndmnt to the PD Ordinance muld allow credit for visitor parking on public streets in single family detached projects.
Currently credit is given only on private streets.
The amendment to Chapter 21.47, the NRPD Ckdinance, muld anend the ordinance to permit irdministrative approval of all minor (4 or less lots) non-residential planned developnents. Currently, the ordinance permits administrative approval
of minor permits under 1 acre. Most of the lots in the industrid area exceed 1 acre in size so the current ordinance is ineffectual.
Staff feels that these anendments will help both the city and the developnent cmunity. The 1st mndment Will encourage mre public streets in detached single family areas. The second mendment will speed up the processing on minor non-residential projects and help reduce the mrkload of staff and the Planning
Ccm-uniss ion .
The Land Use Planning Manager has determined that this project will mt cause any significant environmental impacts and, therefore, has issued a Negative Declaration, dated May 8, 1984, which was approved by the Planning Cmission on June 13, 1984. A copy of the environmental documents is on file in the Land Use Planning Office.
FISCAL IMPACT
There will be no direct fiscal impacts from the proposed change. City
maintenance costs could increase slightly from a snall increase in the nunber of public streets over private streets.

ORDINANCE NO. 9727
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CARLSBAD,
CALIFORNIA, AMENDING TITLE 21, CHAPTERS 21.45 AND 21.47 OF
THE CARLSBAD MUNICIPAL CODE, BY THE ADDITION OF SECTION
21.45.090(d)(3) AND BY THE AMENDMENT OF SECTION
21.47.110(a) TO ALLOW ADMINISTRATIVE APPROVAL OF MINOR NON-
RESIDENTIAL PLANNED DEVELOPMENTS AND TO PROVIDE CREDIT FOR
ON STREET VISITOR PARKING IN PLANNED DEVELOPMENTS.
The City Council of the City of Carlsbad, California, does
ordain as follows:
SECTION 1: That Title 21, Chapter 21.45, of the Carlsbad
Municipal Code is amended by the addition of Section 21.45.090(d)(3)
to read as follows:
(3) Credit for visitor parking may be given for frontage
on adjacent local streets for detached single-family residential
projects subject to the approval of the Planning Commission; not
less than 24' lineal feet per space exclusive of driveway entrances
and driveway aprons shall be provided for each parking space,
except where parallel parking spaces are located immediately
adjacent to driveway aprons, than 20 lineal feet may be provided.
SECTION 2: That Title 21, Chapter 21.47, of the Carlsbad
Municipal Code is amended by the amendment of Sect ion 21.47.110 (a)
to read as follows:
(a) All non-residential planned developments with four or
less units shall be approved in accordance with the provisions of
this Section.
EFFECTIVE DATE: This ordinance shall be effective thirty
days after its adoption, and the City Clerk shall certify to the
adoption of this ordinance and cause it to be published at least
once in the Carlsbad 3ournal within fifteen days after its
adoption.

residential Planned Development Ordinance which permits administrative approval of projects involving four or less
units regardless of the number of units involved.

SUBJECT: ZCA-173 CITY OF CARLSBAD - An amendment to the Zoning
Ordinance to make minor revisions to the Residential and Non-Residential Planned Development Ordinances.
I. RECOMMENDATION
It is recommended that the Planning Commission APPROVE the Negative Declaration issued by the Land Use Planning Manager and
ADOPT Resolution No. 2303 recommending APPROVAL of ZCA-173 to theity Council based on the findings contained therein.
11. PROJECT DESCRIPTION
The proposed amendment would make minor changes to Chapter 21.45,
the Planned Development Ordinance and Chapter 21.47, the Non- Residential Planned Development Ordinance. The first part of
this amendment would deal with visitor parking in residential
planned developments. The proposed amendment would allow credit for guest parking on local public streets serving single family
residences where a minimum of 20 feet of frontage along the lot
is provided per car, exclusive of driveway entrances and driveway aprons. The present ordinance only permits credit for guest
parking on private streets.
The second part of this amendment would deal with administrative approval of non-residential planned developments consisting of
four or less units. Under the existing ordinance, the Land Use
Planning Manager can administratively approve non-residential planned developments consisting of four or less units only if they are located on property less than one acre in size. The
proposed amendment would remove the one acre maximum for
administratively approved minor non-residential planned
developments.
111. ANALY S IS
The Planned Development Ordinance was approved nearly two years ago. During that time staff and developers have utilized the flexibility and the design standards of this ordinance to create
a number of well designed planned developments. The only portion of the ordinance that appears to create problems is the visitor parking section. As the Commission may recall, the previous Condominium and Planned Unit Development Ordinance allowed credit for guest parking on public streets. This created potential congestion problems in the beach area and certain higher density portions of La Costa where multi-family condominium projects were being proposed.
In response to this problem, the present Planned Development Ordinance was worded so that credit could not be given for guest parking on public streets. However, the Planned Development
Ordinance does allow credit to be given for parking on private
streets.
This has helped to alleviate on-street parking problems in
the higher density areas, but creates problems for single family planned developments. Under the existing ordinance a developer either has to provide private streets, or if he chooses to build public streets, he must provide on-site parking when it may not be necessary. In some circumstances, developers would prefer to
create a single family planned development with public streets to reduce maintenance costs for future homeowners but under the existing Planned Development Ordinance, are forced to provide
private streets to take care of the guest parking requirement.
The proposed revision would permit the Planning Commission to
give credit for guest parking on local public streets serving single family planned developments where a minimum of 20 feet is provided per car exclusive of driveway entrances and driveway aprons .
Staff believes that the proposed amendment would give the Planned Development Ordinance enough flexibility to encourage developers to provide public streets in single family planned developments. Requiring 20 feet per car between driveway
entrances and driveway aprons will ensure that there will be adequate space to provide visitor parking.
The second part of this amendment would effect the non-
residential Planned Development Ordinance. The non-residential Planned Development Ordinance allows for administrative approval of minor non-residential planned developments involving less than one acre. This provision severely limits the number of projects that can be administratively approved since most lots in the industrial and commercial portions of the City are larger then one acre in size. The proposed revision would remove the acreage limit of administratively approved minor non-residential planned developments. This would be in conformance with the residential
Planned Development Ordinance which allows for administrative approval of minor planned developments regardless of the acreage involved.
In conclusion, staff believes that both the Planned Development Ordinance and the Non-Residential Planned Development Ordinance are effective in their present form and should not be amended,
except as mentioned in this report. It is a testimony to their
success that they have been used extensively for two years with
only two minor modifications being suggested. Staff believes
the proposed changes will give greater flexibility to each
ordinance, but will not adversely impact the intent of either ordinance. Therefore, staff recommends approval of ZCA-173.

IV. ENVIRONMENTAL REVIEW
The Land Use Planning Manager has determined that this project
will not have a significant effect on the environment and, therefore, has' issued a Negative Declaration on May 8, 1984.
