HD.($f CITY ATTY ftlTY MfiR "^Sā€” RECOMMENDED ACTION: Adopt Resolution No. 'JCfCpH adopting regulations for candidates, and reaffirm the $25.00 filing fee. ITEM EXPLANATION; The date of the next General Municipal Election is November 6, 1984. The nomination period for that election is from July 16, 1984 to August 10, 1984. If the incumbent of an office does not file, the nomination period will extend for 5 days ā€” to August 15, 1984. In preparation for the nomination period, Council needs to adopt regulations for candidates. The attached Resolution has been prepared in accordance with past Council actions and elections. Council may, however, change the regulations in three areas if they desire: 1. The length of candidates statements may be at 400 words maximum rather than the 200 word limit previously established by Council. 2. Council may require the candidate to pay their pro-rated share of printing candidate statements in Spanish rather than having the City pay the Spanish printing costs as previously established by Council. 3. Council may require candidates to pay their pro-rated printing cost in advance when they file their papers rather than after the printing is finished and actual costs are known. ^ Costs for printing Candidates Statements in the last Municipal Election held on June 8, 1982 were as follows: English: $200.85 Spanish: 86.75 A final issue for consideration is the $25.00 filing fee. In accordance with Section 22843 of the Elections Code, a filing fee not exceeding $25.00 may be required. The attached Resolution provides for 200-word statements, billing the candidates after the printing is complete and costs are known, and billing for only the English printing. EXHIBITS; 1. Resolution No. 7/^^*7 adopting regulations for candidates. FISCAL IMPACT: The cost to the City will be actual cost for printing Candidates Statements in Spanish. That cost will depend on the number of candidates. 1 RESOLUTION NO. 7664 2 3 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, ADOPTING REGULATIONS FOR CANDIDATES FOR ELECTIVE OFFICE, PERTAINING TO MATERIALS SUBMITTED TO THE ELECTORATE AND COSTS THEREOF. 5 WHEREAS, Section 10012 of the Elections Code of the 6 State of California provides that the governing body of any 7 local agency adopt regulations pertaining to materials prepared 8 by any candidate for a municipal election, including costs 9 thereof; 10 NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF 11 CARLSBAD, CALIFORNIA, DOES HEREBY RESOLVE, DECLARE, DETERMINE 12 AND ORDER AS FOLLOWS: 13 SECTION 1. GENERAL PROVISIONS. That pursuant to 14 Section 10012 of the Elections Code of the State of California, 15 each candidate for elective office to be voted for at any General 16 Municipal Election to be held in the City of Carlsbad may prepare 17 a candidate's statement on an appropriate form provided by the 18 City Clerk. Such statement may include the name, age and 19 occupation of the candidate and a brief description of no more 20 than two hundred (200) words of the candidate's education and 21 qualifications expressed by the candidate. Such statement shall 22 not include party affiliation of the candidate, nor membership or 23 activity in partisan political organizations. Such statement 24 shall be filed in the office of the City Clerk at the time the 25 candidate's nomination papers are filed. Such statement may be 26 withdrawn, but not changed, during the period for filing 27 nomination papers and until 5:00 P.M. of the next working day 28 after the close of the nomination period. ]_ SECTION 2. SPANISH LANGUAGE. The City clerk shall 2 provide a Spanish translation of the candidate's statement to be 3 made available to any voter upon request, and shall so indicate 4 its availability in the Voter's Pamphlet. 5 SECTION 3. ADDITIONAL MATERIALS. No candidate will be 6 permitted to include additional materials in the sample ballot 7 package. 8 SECTION ». PAYMENT. Each candidate filing a 9 candidate's statement shall be billed for the services rendered, 10 a sum not greater than the actual prorated costs of printing and 11 handling; and such bill shall be due and payable immediately upon 12 receipt thereof. 13 SECTION 5. Each candidate shall pay a $25.00 fee at.the 14 time the nomination papers are filed with the City Clerk. In 15 lieu of the $25.00 filing fee, candidates may process a peti'tion- 16 in-lieu by acquiring four signatures for each $1.00 of the filing 17 fee. A total of 100 signatures of registered voters in the City 18 shall replace the $25.00 filing fee. 19 SECTION 6. That the City Clerk shall provide each 20 candidate, or the candidate's representative, a copy of this 21 resolution at the time nominating petitions are issued. 22 SECTION 7.
