RECOMMENDED ACTION:
Adopt Resolution No.JbJ-/ vacating a portion of Carlsbad
Boulevard between Walnut Avenue and Sycamore Avenue.
ITEM EXPLANATION:
The City Council on July 3, 1984, adopted Resolution No.
7661, a resolution of intention to vacate a portion of msbad Boulevard between Walnut Avenue and Sycamore Avenue. The City Council set July 17, 1984, at the hour of 6 P.M. as the time and the City Council Chambers, 1200 Elm Avenue, as the place for a public hearing for all persons interested in or objecting to said proposed vacation. The utility companies were notified.
Staff recommends that this vacation be conditioned to specify that the entire area being vacated remain an easement for utility purposes. The resolution so specifies.
FISCAL IMPACT:
Approval of this vacation will result in approximately 1300
square feet of land to be returned to the tax rolls.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD,
CALIFORNIA, VACATING A PORTION OF CARLSBAD BOULEVARD
BETWEEN WALNUT AVENUE AND SYCAMORE AVENUE,
The City Council of the City of Carlsbad, California, does hereby resolve as
'07 lows:
1. That all publication and posting notices regarding the proposed vacatio
f a portion of a Carlsbad Boulevard between Walnut Avenue and Sycamore Avenue
ursuant to Resolution of Intention No. 7661 have been given as required by law.
2. That the City Council did hear the evidence offered by all persons
nterested in said proposed vacation and does find from all the evidence submittec
hat a portion of Carlsbad Boulevard in the City of Carlsbad, County of San Diego
tate of California, particularly described on Exhibit "A", attached hereto and b:
his reference incorporated herein, is unnecessary for present or prospective

3. That an easement for all existing utilities is excepted from this

4. The City Clerk is instructed to record this Resolution of Vacation.
