RECOMMENDED ACTION:
If the City Council concurs your action is as follows:
1. Adopt Resolution No. 77/7 , approving GPA/LU 84-3
Alanda and GPA/LU 83-14 Carlsbad Land Investors and
denying GPA/LU 84-4 Robertson.
2. Adopt Resolution No. 97/<f , denying ZC-305 Robertson.
3. Adopt Ordinance No. 971 9 , approving ZC-304 Alanda.
ITEM EXPLANATION
The City Council at your meetings of June 5, July 17 and August 1,
1984 conducted extensive public hearings on requests for
amendments to the Land Use Element of the General Plan. Council
directed our office to prepare a series of documents to accomplish
the Council's intentions in regard to the amendments and other
related requests. Those documents have been prepared and are
attached. If the City Council concurs you should take the series
of actions recommended above. The results of those actions in
regard to the requests are as follows:
1 . GPA/LU 84-3/ZC 304 - ALANDA; Approves an amendment to the
General Plan to change the Land Use Element designation from
RM (4-10 du/acre) to RMH (10-20 du/acre) and a corresponding
zone change on property on the northwest corner of El Camino
Real and the future alignment of Elm Avenue.
2. GPA/LU 84-4/ZC-305 ROBERTSON: Denies an amendment to the
General Plan to change the Land Use Element designations from
RM (4-10 du/acre) and RLM (0-4 du/acre) to C (Community
Commercial) on property located on the southeast corner of El
Camino Real and Tamarack Avenue. Denies a preannexational
zone change to C-1 (Q).
3. GPA/LU 83-14 CARLSBAD LAND INVESTORS; Approves an amendment
to the General Plan to change the Land Use Element
designation from R-L (Residential Law Density 0-1.4 du/acre)
to RLM (0-4 du/acre) on 85 acres of property located south of
Palomar Airport Road and East of Laurel Tree Lane. The zone
change to residential and open space will come later.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA, AMENDING THE LAND USE ELEMENT
OF THE GENERAL PLAN TO CHANGE THE LAND USE DESIGNA-
TIONS FOR TWO AREAS OF THE CITY'S GENERAL PLAN,
GPA/LU 83-14 CARLSBAD LAND INVESTORS AND GPA/LU 84-3
ALANDA AND DENYING A CHANGE GPA/LU 84-4 ROBERTSON.
WHEREAS, the Planning Commission did on April 25 and
June 27, 1984 hold duly noticed public hearings as prescribed
by law to consider amendments to the Land Use Element of the
General Plan GPA/LU 84-3, GPA/LU 83-14 and GPA/LU 84-4; and
WHEREAS, the Planning Commission has determined that
GPA/LU 84-4 would not have significant impacts on the environment
and a Negative Declaration was approved on June 27, 1984, and the
City Council certified EIR 83-8 for GPA/LU 83-14 on June 5, 1984,
and a notice of prior compliance issued April 4, 1984 for GPA/LU
84-3 all in satisfaction of the requirements of the City of
Carlsbad Environmental Protection Ordinance of 1980 and the
California Environmental Quality Act; and
WHEREAS, the City Council did on June 5, July 17 and
August 7, 1984 hold duly advertised public hearings to
consider a series of amendments and at that time received the
recommendations, objections, protests and comments of all
interested persons desiring to be heard; and
WHEREAS, the City Council, after considering all
proposed changes to the Land Use Element of the General Plan,
directed the City Attorney to return with appropriate documents
to allow the City Council to vote on the changes as a part of one
single amendment to the Land Use Element of the General Plan.

NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Carlsbad, California as follows:
1. That the above recitations are true and correct.
2. That this resolution constitutes a single amendment
to the Land Use Element of the General Plan.
3. That the findings of the Planning Commission as set
forth in Planning Commission Resolutions No. 2282 (GPA/LU 84-3)
and 2316 (GPA/LU 83-13) constitute the findings of the City
Council but that the findings of No. 2314 (GPA/LU 84-4) are not
approved.
4. That the Land Use Element of the General Plan is
amended as follows:
A. GPA/LU 84-3 ALANDA; To change the Land Use
Element designation from R-M, 4-10 DU's per acre to RMH, 10-20
DU's per acre on 9 acres of property located on the northwest
corner of El Camino Real and future Elm Avenue as shown on the
map marked Exhibit A, April 25, 1984, GPA/LU 84-3, attached
hereto and made a part hereof.
B. GPA/LU 83-14 CARLSAD LAND INVESTORS; To change
the Lnad Use Element designation from R-4, 0-1.5 DU's per acre
to RLM, 0-4 DU's per acre on 85 acres of property located south
of Palomar Airport Road east of Laurel Tree Lane as shown on the
map marked Exhibit A, 6-27-84, GPA/LU 83-14 attached hereto and
made a part hereof.
5. That the request of Robertson GPA/LU 84-4 to amend
the Land Use Element of the General Plan from RM and RLM to C is
denied.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA DENYING ZONE CHANGE ZC-305
ROBERTSON.
WHEREAS, the City Council by their adoption of
Resolution No. 773.7 has denied GPA/LU 84-4 Robertson, said
resolution is incorporated by reference; and
WHEREAS, the applicant for that general plan amendment
has also applied for a related land use approval ZC-305,
Robertson; and
WHEREAS, because said request is inconsistent with the
existing General Plan designation and since the City Council has
denied the general plan amendment this request must be denied.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Carlsbad, California as follows:
1. That the above recitations are true and correct.
2. That the City Council denies ZC-305, Robertson.
ZC-305 Robertson; A proposed preannexational zone
change from County to C-1-(Q) Commercial on approximately 19
acres of property generally located at the southeast corner of
Tamarack Avenue and El Camino Real as shown on the location map
marked Exhibit Z attached hereto and made a part hereof.

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA, AMENDING TITLE 21 OF THE
CARLSBAD MUNICIPAL CODE BY AMENDING THE ZONING MAP
FROM R-A-10,000 TO RDM-Q ON NINE ACRES LOCATED
ON THE NORTHWEST CORNER OF EL CAMINO REAL AND
THE FUTURE ALIGNMENT OF ELM AVENUE AND FROM
R-A-10,000 TO R-A-10,000(Q) ON 36 ACRES LOCATED
ON THE SOUTHWEST CORNER OF EL CAMINO REAL AND
THE FUTURE ALIGNMENT OF ELM AVENUE
APPLICANT: ALANDA
CASE NO; ZC-304
The City Council of the City of Carlsbad, California,
does ordain as follows:
SECTION 1: Title 21 of the Carlsbad Municipal Code is
amended by the amendment of a zoning map from R-A-10,000 to RDM-Q
and from R-A-10,000 to R-A-10,000(Q) on property as shown on the
map marked ZC-304, Exhibit "A", attached hereto and made a part
hereof.
SECTION 2: This project is approved upon the express
condition that the applicant shall pay a public facilities fee as
required by City Council Policy No. 17, dated August 29, 1979, and
amended on April 2, 1982, on file with the City Clerk and
incorporated herein by reference, and according to the agreement
executed by the applicant for payment of said fee a copy of that
agreement dated March 30, 1983, is on file with the City Clerk and
incofi|ir«ted herein by reference. If said fee is not paid as
promised, this application will not be consistent with the General
Plan and approval for this project shall be void. Said fees shall
be paid based on the April 2, 1982 version of Policy No. 17.
EFFECTIVE DATE: This ordinance shall be effective thirty
days after its adoption, and the City Clerk shall certify to the

adoption of this ordinance and cause it to be published at least
once in the Carlsbad Journal within fifteen days after its
adoption.

Carlsbad City Council on the 7th day of August , 1934
and thereafter
PASSED AND ADOPTED at a regular meeting of said City
Council held on the 21st day of August , 1984, by the
following vote, to wit:
