NO. 7720 .
ITEM EXPLANATION
On April 17, 1984, Council heard testimony on construction of a
sanitary sewer in the vicinity of Buena Vista and Valley Streets and determined that the City would build the sewer with
City funds subject to reimbursement when people in the area
connect to the line. The existing municipal code provides for reimbursement for sewer mains on a front foot basis. The letter dated April 24, 1984 from the Utilities Director explains why that is not fair in some cases. The attached ordinance would allow the City Council to adopt by resolution
an alternative basis for reimbursement - spreading the cost by
benefit measured by dwelling units served. The attached
resolution would establish the reimbursement schedule for the
Buena Vista-Valley project.
A request for proposal for design of the project was
distributed on April 26, 1984. Responses were received and
Brian Smith Engineering of Carlsbad was selected for a fee of
$1,900. The design is forthcoming.

The exact fiscal impact is unknown at this time. Computation will be available when the design estimates are received. The
City Engineei's estimate for the project is $40,000. If the
new Jarvis initiative passes the $715 fee may be invalid.

THAT WE BE ALLOWED TO BE HEARD BEFORE THE CITY COUNCIL AT THEIR NEXT
REGULARLY SCHEDULED MEETING, IN ORDER THAT WE MAY PETITION THEM FOR

The city code provides for a reimbursement procedure for the construction of
sewer lines described as a front line fee (13.08.030). This fee reflects
benefit in circumstances where lots are similar in size and thus have com-
parable frontages on a street. The front line fee tends to be unequitable
in areas such as the proposed benefit area which includes some large unde-
veloped interior lots (panhandles) or raw acreage which fronts the present
streets. It appears that under these circumstances, a more equitable
means of assessing benefit would be on an EDU basis - the total EDU calcu-
lated using existing zoning and the average "yield" for similarly zoned
areas. The area in question is R-1 which requires, as a minimum, 7,500 sq.
ft. lots. Some developed lots are larger (10 - 12,000 sq. ft.), but, it is
considered highly unlikely that they will attempt any lot consolidation to
gain more building lots.

side of the street. This would compute to a cost of $1,853 for Mr. Tell
(1700 Buena Vista Way) for a single EDU and $1,409 for the adjoining unde-
veloped lot which could yield 4 lots or a net cost of $352 per EDU. It
appears to me that the benefit area approach is more equitable than the
front line fee in this circumstance.

ORDINANCE NO . 7068
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA, AMENDING TITLE 13, CHAPTER
13.08 OF THE CARLSBAD MUNICIPAL CODE BY THE
ADDITION OF SECTION 13.08.035 TO PROVIDE FOR AN
ALTERNATIVE PROCEDURE FOR COLLECTING SEWER LINE COSTS.
The City Council of the City of Carlsbad, California
does ordain as follows:
SECTION 1: That Title 13, Chapter 13.08 of the
Carlsbad Municipal Code is amended by the addition of Section
13.08.035 to read as follows:
"13.08.035 Line Costs - alternative procedure. The
City Council may by resolution approve a plat map for an area benefited by a sewer main which provides for a fee determined by
dividing the cost of the sewer main by the number of dwelling units served instead of the cost per front foot as provided in
Section 13.08.030. The provisions of this section are an alternative to those of Section 13.08.030 which may be used when
the City Council determines that they will result in a more
equitable fee . "
EFFECTIVE DATE: This ordinance shall be effective
thirty days after its adoption, and City Clerk shall certify to
the adoption of this ordinance and cause it to be published at
least once in the Carlsbad Journal within fifteen days after its
adoption.

Carlsbad City Council held on the 21st day of August I

RESOLUTION NO. 7720
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA ADOPTING A PLAT MAP TO ESTABLISH
A SEWER MAIN REIMBURSEMENT FEE FOR THE BUENA VISTA -
VALLEY MAIN PURSUANT To THE ALTERNATIVE PROVISIONS
OF SECTION 13.08.035 OF THE CARLSBAD MUNICIPAL CODE
WHEREAS, the City Council of the City of Carlsbad has
adopted alternative provisions for establishing a sewer main
line cost fee in Title 13, Chapter 13.08, Section 13.08.035 of
the Carlsbad Municipal Code; and
WHEREAS, the City Council has determined that a mre
equitable fee will result from said provisions for the Buena
Vista - Valley sewer main project,
NOW, THEREFORE, BE I* RESOLVED by the City Council of
the City of Carlsbad, California, as follows:
1. That the City will construct the sanitary sewer mair
lines in the Valley Street right-of-way from Elm Avenue to Buena
Vista Avenue (approximately 650 feet) and in the Buena Vista
Avenue right-of-way from 1700 to 1780 Buena Vista Avenue
(approximately 320 feet) as shown on Exhibit A, attached hereto
and made a part hereof.
2. That the City Engineer has determined that the
parcels to be served by said line are as listed on Exhibit B,
attached hereto and made a part hereof.
3. That the City Council has determined that a more
equitable fee will result by invoking the alternative procedures
for establishing sewer main line costs as provided in Section
13.08.035 of the Carlsbad Municipal Code.
4. That the plat map, Exhibit A and the benefiting
parcels and dwelling units to be served by the project as shown
on Exhibit B are hereby approved.

5. That the City Engineer is authorized to establish
a line cost fee for each equivalent dwelling unit to be develope(
in the benefited area in an amount to be determined by dividing
the final project cost by 57.
