ENG RECOMMENDED ACTION: 07 declaring the intention to vacate a 6 Adopt Resolution No. portion of Carlsbad B v etween Walnut Avenue and Sycamore Avenue, and setting a public hearing for 6:OO PM, Tuesday, September 4, 1984. ITEM EXPLANATION: A request to vacate a public street easement on a portion of Carlsbad Blvd. was made by Alfred Fiechter, owner of the property. Staff has reviewed the request and concluded that the excess street right-of-way is not needed for the ultimate street widening. Carlsbad Blvd. (formerly State Highway 101) is a major arterial, which would typically call for a 102-foot right-of-way. However, in the blocks to the south and north of the subject block, its right-of-way is 100 feet, which is adequate to accommodate the physical improvements needed. Since the right-of-way in the subject block is 110 feet, a 10-foot relinquishment would standardize the width along the street. By City Council Resolution No. 7681, on July 17, 1984, a similar 10- foot strip on the three other lots in this block was vacated by the City. Utility companies have been notified of the vacation. There are no known utility easements on the property. Full-street improvements are in place and no conditions need be imposed. FISCAL IMPACT: Approval of this vacation will result in approximately 425 square feet of land to be returned to the tax rolls. EXHIBITS: 1. Location Map declaring the intention to vacate a %% 2. The City Council of the City of Carlsbad, California, does hereby resolve as follows: 1. The City Council of the City of Carlsbad hereby declares its intentions to proceed, under the provisions of Public Streets, Highways, and Service Easement Vacation Law of 1981, to vacate a portion of Carlsbad Blvd. between Walnut Avenue and Sycamore Avenue, located in the City of Carlsbad, County of San Diego, State of California, particularly described on Exhibit A. 2. A public hearing shall be held at the City Council Chambers at 1200 Elm Avenue, Carlsbad, California, at 6:OO P.M. on September 4, 1984, for the purpose of hearing all persons interested in or objecting to said proposed vacation.
