RECOMMENDED ACTION:
Adopt Resolution of Intention No. 172 to initiate consideration of an amendment
to the zoning ordinance as it relates to automobile dealerships and directing
the Land Use Planning Manager to set the matter to a public hearing before the
Planning Commission.
ITEM EXPLANATION
By letter dated August 10, 1984, the Meister Campany is requesting that the City
Council initiate an amendment to the zoning ordinance to allow consideration of
automobile dealerships in the P-M (Planned Industrial) Zone by conditional use
permit. locate in Carlsbad and the possibilities of expanding the existing Car Country
on the east side of 1-5 are pretty much non-existent.

not had sufficient time to adequately study all the implications of this request and formulate a recarmnendation since the letter frm the Meister Company was expedited to Council for consideration. Therefore, if the City Council desires to initiate a public hearing to consider this matter, staff recommends that the consideration be left somewhat open-ended so that other alternatives and qtions which muld address this matter can be considered. The attached resolution of intention has been prepared to reflect an open-ended consideration. take approximately two months before this matter could be considered by the Planning Cmission at a public hearing.

RESOLUTION OF INTENTION NO. 172
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD,
CALIFORNIA DECLARING ITS INTENTION TO CONSIDER AN AMENDMEN' OF TITLE 21 OF THE CARLSBAD MUNICIPAL CODE.
Pursuant to Section 21.52.020 of the Carlsbad Municipal
:ode, the City Council of the City of Carlsbad hereby declares its
intention to consider an amendment of Title 21 of the Carlsbad
lunicipal Code as it relates to the location and the review of
sutomobile deaalerships in the City of Carlsbad.
The Land Use Planning Manager is directed to prepare a
report on this matter and to set the matter for public hearing
Defore the Planning Commission.
PASSED, APPROVED AND ADOPTED at a regular meeting of the
:ity Council of the City of Carlsbad, California, held on the 21st
lay of August, 1984 by the following vote, to wit:

Jc RE: Amendment to PM Zoning Ordinance
Dear Ms. Casler and Council Members
Due to the current demand and lack of supply of parcels within the City of Carlsbad for use as automobile dealerships we are
proposing the following solution.
Please accept this letter as our formal request to amend the
PM Zoning Ordinance to allow by CONDITIONAL USE PERMIT the
construction and operation of automobile dealerships. Specific
reference is made to the PM Zone west of 1-5 between Cannon
Road and Palomar Airport Road.
By allowing automotive use by CUP only, the City can control in
which areas of the PM Zone dealerships may locate. This proce- dure allows the City to continue to maintain absolute control and jurisdiction over location andd2sign of dealerships.
We have six acres along Avenida Encinas on the west side of 1-5 near Cannon Road in the PM Zone under purchase contract. We can locate three dealerships on the parcels indicated on the attached Exhibit. These dealerships, including Subaru currently located in Oceanside, may other wise be forced to locate outside the
City of Carlsbad.
Our need is immediate and since time is of the essence under our
purchase agreement we ask that at your next council meeting you
direct the planning staff to amend the PM Zone Ordinance. We
have met with Mike Holtzmiller and he appeared to favor this
approach.
We look forward to your favorable response. Thank you for your
