a) increase the potable water rate by .Olt to 74.50 per cu.ft. and,
b) increase the fee for reinstatement of water service after turn-off for non-
payment by $11.50 (from $8.50 to $20.00) and establishing a fee of $10 for
turn -on or turn-off service.
ITEM EXPLANATION:
1. Construction meters are "loaned" (leased) to contractors for installation on fire
hydrants. We currently charge them $135 ($35 for one year's use and $100 deposit
against the billing for future use and possible loss or damage). This fee is low
based on the replacement cost for the meter and is low by comparison with other
local agencies. We have not lost any meters as yet but the deposit would not
cover the cost, however we do have meters on loan for the full year as the
contractor has less at risk by using his meter in Carlsbad for jobs in other
jurisdictions. The increase to $50 for one year's use and $350 for a deposit
or $400 for the initial investment by the contractors will cover our costs and
bring our prices into consistancy with other jurisdictions.
Additionally it is recommended that a relocation fee of $20 be included to defray
the City cost of going to a location, removing the meter, transporting to a new
location and installing. A cost analysis for these charges is included as an
exhibit.
2. Water rates and fees as set by Resolution, therefore the following changes are
recommended to our present rate Resolution:
a) Increase the basic water rate by .010 per 100 cu.f t. (from 73.50 to 74.50).
This increase is a pass through of the .01(' per unit increase from the Metro-
politan Water District via the San Diego County Water Authority and Costa Real.
The CRMWD Resolution setting this rate is attached.
b) We do not presently have a charge to turn off water when service is terminated.
It is recommended that a $10 fee be included as this is the cost of providing
this service.
c) We presently have a $3.30 charge for turning the water on for new accounts.
It is recommended that this charge be increased to $10 as this is the cost of
providing this service.
d) It is further recommended that a fee of $20 be charged as a penalty for non-
payment of bills and restoration of service since this requires a turn-off
(attention getters) and a turn -on (restoration) of service.

The "turn-off" charge is a new fee, the "turn -on" fee and the "restoration of
service" fee are increases to more nearly cover the cost. Exhibit 2 includes
rationale to support those fees and the fee analysis was included in the David
M. Griffith report which is attached as Exhibit 3.

FISCAL IMPACT:
1. Revision to Section 14.16.130 will add approximately
Enterprise Fund, annually. pp Y $1215.00 to the Water

non-payment of water bills will add approximately $7500 annually to the Water
Enterprise Fund.
3. $.01 increase in water rates will generate $52,272.00 annually for Costa Real
Municipal Water District. There will be no fiscal impact to the City.

I have checked six (6) different water departments or water districts to
compare our charges with theirs for the use of construction meters. I
found the following information:
a) Average cost for a 3" construction meter is $350 for one year.
The City of Carlsbad charges $135 for one year.
b) Four out of the six charge a set-up fee of between $20 and $50.
The City of Carlsbad charges nothing.

c) Two our of the six charge a fee of between $15 - $25 to move a construction
meter from one location to another.
The City of Carlsbad charges nothing.
The following recommendation is based on those findings:
1. That the charge for a construction meter be increased from $135 for one
year to $400 per year.
REASON FOR THE INCREASE:
a) To cover the cost of a construction meter should it be lost, stolen
or damaged in any way.
b) To cover the fittings supplied with each construction meter should
they be lost, stolen or damaged in any way.
c) Cost to the City are for construction meter and fittings:

2. That the rental fee of $35 for one year be increased to $50 for one (1)
year with the balance of $350 refunded back to the user upon return of
the construction meter in good working condition including all fittings
and valves supplied by the City.
REASON FOR THE INCREASE:
a) This fee will cover the costs to the City for both time and labor
involved in making up the construction meter and making periodic
checks on it, plus returning it to the meter shop.
3. That an additional $20 service charge be required if a contractor requests
to have his/her construction meter relocated to a new location.
REASON FOR THE CHARGE:
a) To cover the time and the labor involved by personnel from the meter
shop to accomplish this work:

PENALTY PAYMENT FOR DELINQUENT WATER BILLS
I have checked four (4) different water departments or water districts to
compare our pe,:slty charge for non payment of water bills and found the
following information:
(A) Average *penalty charges is $20.00
City of Carlsbad charges $8.25
The following recommendation is based on those findings:
1. That the penalty for reconnection of service due to delinquent
payment of the water bill be increased from the present $8.25
to $20.00.
REASON FOR THE INCREASE:
To cover the time and the labor involved by personnel from the meLer shop to
accomplish this work.
Cost to the City to reinstate service that has been discontinued due to non
payment of water bill:
1 - man $12.23 per hour
1 - truck 4.00 per hour
Overhead (15%) 2.43
Total Cost $18.66
This amount does not include overhead incurred by staff of the Finance
Department for handling delinquent bills.

EFFECTIVE SEPTEMBER 1, 1984
WHEREAS, the Board of Directors of COSTA REAL MUNICIPAL WATER
WATER DISTRICT adopted Resolution No. 401 on September 3, 1980, which

the District; and
WHEREAS, the Board of Directors of COSTA REAL MUNICIPAL WATER
DISTRICT adopted Resolution No. 427 on July 7, 1982, which in part es-
tablished the water rate for retail water delivered by the District
after July 1, 1982; and

WHEREAS, the Board of Directors of COSTA REAL MUNICIPAL WATER
DISTRICT has determined that a revision of the charges of water de-
livered is necessary; and
WHEREAS, written notice has been given to the CITY OF CARLS-
BAD of the proposed revision of rates in accordance with the notice
filed by the CITY OF CARLSBAD, in accordance with Section 54992,
Government Code of the State of California.
NOW, THEREFORE, THE BOARD OF DIRECTORS OF COSTA REAL MUNI-
CIPAL WATER DISTRICT DOES HEREBY RESOLVE AS FOLLOWS:
1. That portion of Paragraph 1 of Resolution No. 401, Reso-
lution No. 440 and Resolution No. 443 relating to rates for wholesale
water delivered by COSTA REAL MUNICIPAL WATER DISTRICT is amended to
read as follows:
The rates on monthly basis charged for all
wholesale water delivered by COSTA REAL
MUNICIPAL WATER DISTRICT shall be at the
rate of $325.25 per arse foot.
2. That portion of Paragraph 1 of Resolution No. 427 and

SECTION X
WATER FUND
i
The Water Fund is an enterprise fund supplying water services to City
residents. In December 1983, the Fund consolidated services with the Costa Real
Municipal Water District. The revised 1983-84 budget was used in developing the
Cost Module. In addition to the sale of water, income is generated through a turn
on fee, a turn off fee for delinquent accounts, meter installation, and as a recovery
to the General Fund, payment for administrative services. Our study indicated that
the costs of providing these services are significantly in excess of revenues

E generated. The following table summarized current revenue, actual cost/potential

revenue, and the net increase. The analysis assumes full impler entation of the
cost schematic and a continuation of present activity levels:

The following sections develop the data base leading to the above revenue
increases.
A. ADMINISTRATIVE FEE

The City's General Fund provides two types of services to the Water
1
Fund. The first service is administrative support from Utilities management,
and the second central service overhead (indirect) costs by Finance,
Personnel, Purchasing, etc. Based on the 1984 budget, the total
administrative support cost from the General Fund to the Water Fund was
$203,665 - exclusive of direct administrative services from Utility
Management. For details of this charge, please refer to the Cost Module
(summary Schedule A and all appropriate Plan sections which allocate costs
to the Water Fund).

It should be noted that the above mentioned administrative charge is
$108,332 higher than that estimated by the City. The increase rnay be
attributed to inclusion of certain cast centers not included in the City's
distribution; specific, detailed analysis of the services provided, i.e, the
creation of cost centers with specific target services as opposed to a more
general distribution; and to the build-up of service costs in the overhead
departments.
B• DELINQUENT ACCOUNTS
a
The City currently has approximately 200 delinquent water accounts
per
month. Of this total, 75 or 900 on an annual basis, are delinquent tohe
extent that water service will
be turned off. The charge for reconnection is
$8.25, generating pro -forma income of $7,425.
Our study indicates that the actual cost of the service,' is $4"1.90 which,
at the 900 annual service units, would generate income of
revenue increase of $43,1I0, or a
$35,685. The $47.90 charge results from services
provided by the Utility Billing section of the Finance Department ($9.90 per
,d account) and the Water Department ($38.00 per account). It should b e noted
that the latter cost includes two complete trips to the meter, one to turn off
the meter, the second to turn it back on.

C. NEW ACCOUNT TURN ON
New accounts are being processed at the rate of 225 per montj, or 2,700
Per year. The City currently charges $3.30 to initiate the account. Our study
indicates that the actual cost of the service is $28.90. The charge results
from services provided by the Finance Department ($9.90) and the Water
Department ($19.00). It should be noted that the full charge assumes a single
trip per installation, when on numerous occasions travel time can be reduced
by efficient scheduling. If the new account rate were established at the full
cost, the City would realize additional income of $69,120.

D. METER INSTALLATION FEE
The Water Department charges a fee to install meters. Installation of
service to the Main is now done by Costa Real. The fee is dependent upon the
size of meter (3/8" to 2") and includes both the direct cost of the meter and
installation time. Our analysis indicates that the installation portion of the

fee is reasonable and no change is recommended.

RESOLUTION NO. 7747
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF CARLSBAD REVISING WATER RATES
AND CHARGES
WHEREAS, Section 14.04.030 of the Carlsbad Municipal Code empowers the
City Council to, from time to time, by resolution, adopt rules and regulations
for the operation and maintenance of the Water Department of the City, and for
furnishing water to users, and empowers the Council to, by resolution, modify
rates, charges and penalties respecting water service.
NOW, THEREFORE, BE IT RESOLVED that the hereinafter stated regulations
respecting water rates, charges, billing and related regulations shall become
effective for all water billed after September 1, 1984.
I. Generally. The schedules rates, compensations, charges and minimum
charges as set out in this resolution are fixed and established as the rates,
compensations, charges and minimum charges to be charged and collected by the
City for domestic water and water service, except as otherwise specifically
provided.
II. Water Charges.
(a) There shall be a separate monthly water standby charge for
each consumer; provided that there shall be only one monthly
standby charge for each equivalent dwelli.g unit, each
agricultural and industrial consumer, and each institutional
consumer as follows:
For a 5/8" meter $ 4.40
For a 3/4" meter $ 4.40
For a 1" meter $ 5.45
For a lilt meter $ 5.90
For a 2" meter $ 6.40
For a 3" meter $12.30
For a 4" meter $15.40
For a 6" meter $15.40
For an 8" meter $23.70

(1) When one meter serves multiple dwelling unit- or
multiple equivalent dwelling units, the first

unit shall pay the unit rate based on the above
schedule and all other units shall pay $2.53

for each additional multiple residential unit.

(2) In the event no water is used through the meter
or the property becomes vacant, the monthly standby
5
charge will be charged and paid by the owner thereof.

(b)
The rates to be charged for potable water supplied in any one
month through meters are as sollows:

(c)
All agricultural consumers who meet the Metropolitan Water District
Southern California require„ients for agricultural consumers receive

a pro-rata share of the agricultural rebate the City receives
monthly from the Costa Real Municipal Water District.

(d)
There shall be a monthly charge of five dollars per month for all
12
water connections supplying non -metered water for fire sprinkler
purposes. All maintenance or repairs to fire service systems from
13
the water main to the shut off valve shall be paid for by the consumer
and shall be charged on the regular water billing. All fire service
14
systems shall be equipped with a meter by-pass which shall be paid
for an installed at the consumer's expense. In the event water is
15
served through the fire service system, the City Water Department
and the Fire Department shall estimate the amount of water used and
16
the regular charge therefore shall be put on customer's bill and
shall be paid by consumer.

(e)
A monthly fee of one dollar shall be paid for each five rooms in any
18
hotel, rooming house or motel, in which no cooking is allowed.

I (f)
A monthly fee shall be charged for each individual living unit con-
tained in any motor court, motel, hotel, or rooming house or other
20
transient type habitat which allows cooking in rooms in the amount
of .700 in addition to other charges established.

(g)
A charge of. Twenty Dollars ($20.00) will be assessed for the restor-
22

III.
Payment of Bills. All water bills are due and payable at the City

Hall of
the City of Carlsbad upon presentation and are delinquent if not paid
25
by the
15th of the month following the monthly billing.

IV.
Meter Reading - Water District. For convenience in the reading of
27
meters
and preparation of water bills, the department is expressly authorized

1 to divide the City into districts. These districts may, from time to time, be
2 revised or changed as necessary or desirable, in order to equalize the work of
3 reading meters and billing. The meters in each district so established shall
4 be read and water bills based on such meter readings, shall be prepared and
5 mailed to the consumers in each district on approximately the same day of each
6 and every month, except when Saturdays, Sundays and legal holidays intervene.
7 V. Bills - Mailings. Unless the applicant for water service directs
8 otherwise, all bills will be mailed to the premises where water service is
9 furnished.
10 VI. Change of Ownership or Occupancy - Notification. It shall be the
11 duty of every person signing an application for water delivery and of every
12 owner of property to which water is delivered to notify the Water Department of
13 any change in the ownership or occupancy of the premises to which the. water is
14 to be furnished at least two days prior to such change. Every applicant shall
15 be liable for the water furnished and metered in accordance with the appli-
16 cation until the Water Department receives written notice to cancel same and
17 shut off the water, when the applicant's liability shall cease except as to
18 water used previous to such notice. Every owner of property is liable for water
19 1 furnished to any premises he has rented in the event the tenant does not pay
20 the water bill. Water service shall not be given any consumer upon ..ange of
21 address until all delinquent charges owed by the consumer at a former place of
22 residence or business shall be paid.
23 VII. Terminating Accounts/New Accounts - Charge for Turnin Water On or Off.
24 Regulation of water service; turning on and off of water supply. A ten dollar
25 ($10.00) charge will be made incident to the closing of an account. A ten
26 dollar ($10.00) charge will be made by the department for turning on the water
27 supply when requested by the consumer incident to the opening of a new account.

VIII. Nonpayment - Service Discontinuance. In the event that any consumer
shall be delinquent in the payment of his water bill, and such delinquency
shall continue for a period of ten days after the final date for payment of
such bill, the department shall have the right forthwith to discontinue water
service to the premises of such delinquent consumer. A reconnection charge of
twenty dollars ($20.00) will be assessed if the service is terminated and
subsequently restored. Water shall not again be supplied to him until all
delinquent water bills, plus the penalties thereon, and reconnection charges,
has been paid.
IX. Restoring Service After Discontinuance. Procedures for restoring
service after delinquency period. If water service is cut off or discontinued
for failure to pay delinquent bills, such service may again be established
only in the event the consumer or the applicant for service at such place pays
all delinquent bills, charges and penalties, and makes such cash deposit as may
be required by the Water Department.
When an owner or consumer has been delinquent in his water bills twice in
succession or three times in any one calendar year, he shall be required to
deposit a sum equal to an average two month's water bill upon such premises
and pays, in addition thereto, the sum of Twenty Dollars (20.00) for turning
on the water supply. Thereupon and not otherwise will water service again be
made or established to the premises where the water bill has been delinquent.
X. The Rates and Charges established by this resolution shall on their
effective day supersede the rates established by Resolution No. 7454.

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF CARLSBAD, CALIFORNIA, AMENDING TITLE 14,
CHAPTER 14.16 OF THE CARLSBAD MUNICIPAL CODE
BY -THE AMENDMENT OF SECTION 14.16.130 AND BY
THE ADDITION OF SECTION 14.16.140 TO ESTABLISH
A FEE FOR NON-PAYMENT OF WATER BILLS.
The City Council of the City of Carlsbad, California does ordain as
follows:
Section 1: That Title 14, Chapter 14.16 of the Carlsbad Municipal Code is
iamended by the amendment of Section 14.16.130 and by the addition of Section
14.16.140 to read as follows:
14.16.130 Loan Meters: The Water Department of the City of Carlsbad
may connect a loan meter to any water service or service pipe upon proper
application. A charge of Fifty Dollars ($50.00) per meter per service location
with a depo it of Three Hundred Fifty Dollars ($350.00) shall be made for loan
meters. The deposit will be refunded after the meter is returned in good working
order complete with fittings, and all bills pertaining thereto are paid. The
meter will be installed and removed by city employees. Any damage caused to
the meter by the negligence or carelessness of any person to whom a meter is
loaned must be paid on demand. Water delivered through a loan meter will be
charged at the usual city rates, including stand-by charges. An additional
charge of Twenty Dollars ($20.00) will be charged upon each request to have a
11loan meter relocated.
14 16.140 Fee for Non -Payment of Water Bills: A fee of Twenty Dollars
($2).00) to reinstate service that has been discontinued due to non-payment
of water bill is hereby established.

EFFECTIVE DATE: This ordinance snail be effective thirty days (30)
after its adoption, and the City Clerk shall certify to the adoption of
this ordinance and cause it to be published at least once in the Carlsbad
Journal within fifteen days (15) after adoption.
