RECOMMENDED ACTION:
Introduce Ordinance y�and adopt Resolution'7'
ITEM EXPLANATION:
The City has been taking a series of actions in order to be able to distribute
reclaimed water purchased from the San Marcos County Water District (SMCWD).
Actions completed to date include modification of the SMC{JD discharge
approval of the purveyor permit, designation of the Water Master a permit,
Standards and Rule and Regulations for Distribution of Reclaimed Water v and
installation of line and connection to the San Marcos line. The Director of
Utilities and Maintenance has met with SMCWD on several occasions to develop
an appropriate pricing policy. SMCWjD did approve a wholesale reclaimed water
rate at their meeting
of July 10, 1984, of 55.1250 per 100 cubic feet. This
price is about 75% of the retail price for potable water and is based on
Operations & Maintenance cost recovery for the Meadow Lark Plant.

ORDINANCE NO. 4018
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD CALIFORNIA, AMENDING TITLE 14, CHAPTER
14.04 OF THE CARLSBAD MUNICIPAL CODE BY THE
ADDITION OF SECTION 14.04.010 (15) TO PROVIDE
FOR THE DEFINITION OF "WATER"
The City Council of the City of Carlsbad, California, does ordain as
Ifollows:
SECTION 1: That Title 14, Chapter 14.04.010 is amended by the addition of
Section 14.04.010(15) to read as follows:
"14.04.010 �15) "Water". "Water" means potable water fit for human
consumption in accordance with applicable standards and reclaimed water
which as a result of the treatment of domestic waste water is suitable
for direct beneficial use or a controlled use that otherwise would not
occur and which meets the standards of Title 22 of the California
A0mia;strati.ve Code."
EFFECTIVE DATE: This ordinance shall be effective thirty days after its
adoption, and the City Clerk shall certify to the adoption of this ordinance
and cause it to be published at least once in the Carls►,ad Journal within
fifteen days after its adoption..

RESOLUTION NO. 7748
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF CARLSBAD FSTABLISHING A RECLAIMED WATER RATE
WHEREAS, Section 14.04.030 of the Carlsbad Municipal Code, empowers the
City Council to, from time to time, by resolution to set rates, charges and
penalties respecting water service,'and
WHEREAS, reclaimed water is a new category of water and will have a
district rate established.
NOW, THEREFORE BE 1T RESOLVED that the hereinafter stated regulations
respecting water rates will become effective for all water bill after
September 1, 1984.
I. Reclaimed Water for all classes: 55.1250 per 100 cu. ft.
PASSED, APPROVED, AND ADOPTED at a regular meeting of the City
held on the 18th day of September, 1984, by the following vote, to wit:

Minutes of Regular Meeting, July 10, 1984, continued
Director Mahr advised that he cast a negative vote because he felt the price
of reclaimed water should be directly related to the cost of operating the
Treatment Plant, and that the District should not sell the warp►• below the
cost of producing 4t.
In further review of the Budget, the Manager recommended that there ae no
increase in the water or sower rates at this time.
Finance Committee Meeting review of Budget is set for July 12, 1984.
Engineering Committee review of Budget is set for July 18, 1984.
Recommendation from both Committees is to be presented at the Board Meeting on
July 24, 1984.
REPORT OF GENERAL MANAGER
Payback on Wulff Pump Station
Manager reported that the Wulff property is in receivership, and therefore it
is unlikely the District will receive any further payments on his balance of
f $7,128.87. However, a small surcharge placed on the water cost for this

Gradient would remove this deficit.
The Board directed that Staff supply counsel with all correspondence and
information regarding this matter so that a recommendation can be made for
collection of the remaining funds.
Water Agencies Association Meeting
Manager advised that the WAA meeting will be held July 19, 1984• at Si ngi ago
Hills Country Club in E1 Cajon.
t Review of Manager's Salary
Pursuant to Board instruction, Manager requested that a Personnel Committee
meeting be scheduled for the annual review of the Manager's sa:i��t^y. the
Committee meeting is set for July 13, 1984.
REPORT OF DISTRICT COUNSEL
Mr. Pet tzer , reviewed the status of the four bills t,lti c(t were i rttraduccd
through the Intergovernmental Relations Committee. He also advised that as <,
result of a meeting of this Committee, it was decided to reactivate the San
Diego County group of the California Special Districts Association to provicity
a unified position wher dealing with other government units.
REPORT OF CONSULTING ENGINEER
Mr. Stone reported that the application for the Tunnel grant is still being
processed. Mr. Delaney at the Regional Board has been asked to assist tj.
District in expediting the grant processing.
SAN DIEGO COUNTY WATER AUTHORITY
Director Mason reported that the Meeting 4rill be held Thursday, and some itcrs
to be discussed include the status of the MWD Imperial Irrigation District
negotiations on lining the canals to recover possible water, a report from
Larry Hirsch. Borrowing $7 Million under Section 8, Interim Financing, prier
to floating a bond issue. Halis Doe was reappointed as the representative from
Bueno Colorado M.W.D., and Andy Anderson from Rincon M.W.D.
ENCINA WATER POLLUTION CONTROL FACILITY
Director Mahr advised that the Encina representative from the City of Cavlslh«(I
is now Bob Prescott, replacing Mary Cassier.

AUTHORIZE EXECUTION OF LICENSE TO INSTALL SEWER MAIN UNDER RAILROAD
Manager advised that the Agreement being presented is a standard form used by
the Railroad Company for installation of sewer mains under the railroad. He
recommended the Board authorize its execution.

} REQUEST FROM RINCON DEL DIABLO M.W.D. FOR UTILIZF,ION OF
E C SS CAPACITY IN THE BITNO CONNECTION -
Manager advised that informal discussions have been held with Rincon
concerning Rincon's use of excess rapacity in the District's Buena J)
connection. The Buena II connection is used to supply water into the Richland
gradient, gradient, and the District's master plan 'includes this connection to Rincon.
Manager recocrcnends commencing formal talks with Rincon in this regard.
President Mason directed that the Engineering Committee participate in
discussions regarding Rincon's use of the Buena Ii Connection.
DRAFT BUDGET FOR FISCAL YEAR 1984-1985
Presi cent Mason directed that the Budget be reviewed by the [trig i ncer•i ng
Committee and the Finance Committee for recommendation to the Board. However
he opened the floor for any general questions or comments by the Board.
Discussion was held regarding the $268,000 for the operation of the Meadowlark
Reclamation Plant, which is approximately 4% of the initial V Mi11ioil
investment. Upon questioning by 'the Board, staff reported that negotiations
for the sale of reclaimed water to the City of Carlsbad have not progressed
per the instructions of the Engineering Committee and pending the report from
John S. Murk Engineers, Inc. regarding the operating costs of Meadowlark,
However, previous to this time, the Board had discussed and approved a salsa
price of 75% of the cost of the City of Carlsbad's potable wafter, or 541V per
100 cubic: feet. This is also equivalent to 80% of the cost of untreated water
from the San Diego County Water Authority.
Manager explained that whatever rate is set at this time is a starting point,
to be reviewed no less than annually, and to be tied into the cost of
operating Meadowlark when it is feasible to do %o.
District Counsel advised that when the District begins selling reclaimed
water, it has the same responsibility to c:onti nut- that deli very as it word d
for potable eater. However, if the District determined at some later date
that the Meadowlark Plant would be shut down, then a reasonable length of time
should be given to the reclaimed customers to make arrangements for other
sources of water.
