TITLE ESTABLISHING PARKING PROHIBITIONS AND RESTRICTIONS ON CARLSBAD BOULEVARD

RECOMMENDED ACTION:
revising Section 10.40.041 and replacing Section %?- 40.042 of the Municipal Code by Adopt Ordinance
establishing limits alon Carlsbad Boulevard for (a) No Parking Day or Night, (by N o Parking Between 11:OO P.M. and 6:OO A.M., and (c) Parking Off Pavement.
ITEM EXPLANATION:
The Municipal Code Sections dealing with parking along Carlsbad Boulevard were last revised in 1972. Since that
time, there have been several changes in beach use, and in
areas where nighttime parking is undesirable.
The proposed ordinance has been developed in cooperation with the Police Department. In the past, parking enforcement has been difficult for the police because some of the limits were expressed in surveying language (such as, "from the northerly line of Section 29, T12S-R4W to a point 4800 feet southerly thereof").
The new language utilizes recognizable physical points such as streets and bridges. It will assist the police in proper enforcement and also the Utilities and Maintenance Department in proper posting of the zones.
A map has been prepared using color coding to graphically
depict the limits of the three kinds of parking zones and will be on file in the Engineering Department.

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA, AMENDING TITLE 10, CHAPTER
10.40 OF THE CARLSBAD MUNICIPAL CODE BY THE
AMENDMENT OF SECTION 10.40.041 AND THE REPEAL OF
SECTION 10.40.042 ESTABLISHING PARKING PROHIBITIONS
AND RESTRICTIONS ON CARLSBAD BOULEVARD
The City Council of the City of Carlsbad, California, does ordain as
follows :
SECTION 1: That Title 10, Chapter 10.40 of the Carlsbad Municipal Code
is amended by the amendment of Section 10.40.041 to read as follows:
"10.40.041
(a) The parking of vehicles is prohibited during all hours of the day
Parking restricted on certain parts of Carlsbad Boulevard.
The east side between Pine Avenue and the South City Limits;
The east side between Beech Avenue and Christiansen Way;
The east side between a point 170 feet north of Beech Avenue
The west side between Mountain View Drive and the North City
The west side between Elm Avenue and Cherry Avenue;
and night at the following locations along Carlsbad Boulevard:

(6) The west side between a point 160 feet north of Redwood Avenue
and the North City Limits;

and the South City Limits, except at those locations where parking is
permitted between the hours of 6:OO A.M. and 11:OO P.M., as provided in

Hedionda Lagoon bridge (at exit of beach parking lot) and a point 300 feet
north of Tierra del Oro;

SECTION 2: That Title 12, Chapter 10.40, Section 10.40.042 of the
Carlsbad Municipal Code is repealed.
EFFECTIVE DATE: This ordinance shall be effective thirty days after
its adoption, and the City Clerk shall certify to the adoption of thls
ordinance and cause it to be published at least once in the Carlsbad 3ournal
within fifteen days after its adoption.
