SALE OF RIGHT-OF-WAY
SO-CAL DEVELOPMENT COMPANY
It is recommended that the City Council authorize sale of surplus land ir
conjunction with dedication of new right-of-way for Anacapa.
ITEM EXPLANATION:
To eliminate a very sharp curve on Anacapa,
alignment from So-Cal Development in conjunction with their proposed 9.5
acre development.
surplus right-of-way no longer needed.
The surplus right-of-way is in two parts (0.95 acres and 0.25 acres)
totaling 1.2 acres.
The net surplus acreage is 0.7 acres (Exhibit IIA").
In return for the surplus right-of-way the developer proposes to dedicatf
land within the 5 acre open space area to the north of the proposed projf
(Exhibit lfB1l) claiming that the land could be used by the City, perhaps :
a parking lot.
Staff position is that the land to the north is open space and is impact(
by the flow of Encinas Creek. If any public parking were to be needed ir
the area, it could be furnished in the area between the northbound and
southbound roadways of Carlsbad Boulevard.

If the action involves a cash settlement, the Council can determine any
fiscal impacts based on that amount. Overall impact should be positive.
