CITY Am& STREET VACATION OF A PORTION
OF PINE AVENUE pQ. 4&5 ClTYMGR.
Adopt Resolution No. 779/ declaring the intention to
vacate a portion of Pine Avenue and setting a public hearing for
6:OO P.M., Tuesday, November 20, 1984.
ITEM EXPLANATION:
A request to vacate excess street right-of-way on a portion of
Pine Avenue was made by the owner, Pautsch Enterprises, Inc.
They are currently working on plans for an apartment project
adjacent to the area to be vacated.
Staff has reviewed the request and concluded that the excess
street right-of-way is not needed for the ultimate street
widening. Pine Avenue is a collector street with a required '
right-of-way width of 60 feet. The City currently has 80 feet
of right-of-way on the above street. A'similar vacation on the
south side of the street was granted by the City on February 7,
1984.
Utility companies have been notified of this vacation. An
easement for all existing utilities is exempt from this
vacation.
FISCAL IMPACT:
Approval of this vacation will result in approximately 3100
square feet of land to be returned to the tax rolls.

RESOLUTION NO. 7791
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA, DECLARING ITS INTENTION
TO VACATE A PORTION OF PINE AVENUE.
The City Council of the City of Carlsbad, California, does
hereby resolve as follows:
1. The City Council of the City of Carlsbad hereby declares
its intention to proceed, under the provisions of Public Streets,
Highways, and Service Easement Vacation Law of 1981, to vacate a
portion of Pine Avenue, located in the City of Carlsbad, County
of San Diego, State of California, particularly described on
Exhibit "A".
2. A public hearing shall be held at the City Council
Chambers at 1200 Elm Avenue, Carlsbad, California, at 6:OO P.M.
on November 20, 1984, for the purpose of hearing all persons
interested in or objecting to said proposed vacation.

PASSED, APPROVED AND ADOPTED at a regular meeting of the City
