H *k CITY MORrn* CITY ATTYm The City Council on November 6, 1984, adopted Resolution No. 7791, a resolution of intention to vacate a portion of Pine Avenue between Lincoln Avenue and the AT&SF Railroad. The City Council set November 20, 1984, at the hour of 6 P.M. as the time and the City Council Chambers, 1200 Elm Avenue, as the place for a public hearing for all persons interested in or objecting to said proposed vacation. The utility companies were not if ied. Staff has reviewed the request and concluded that the excess street right-of-way is not needed for the ultimate street widening. Pine Avenue is a collector street with a requir'ed right-of-way width of 60 feet. The City currently has 80 feet of right-of-way on the above street. A similar vacation on the south side of the street was granted by the City on February 7, 1984. Staff recommends that this vacation be conditioned to specify that the entire area being vacated remain an easement for utility purposes. The resolution so specifies. FISCAL IMPACT: Approval of this vacation will result in approximately 3100 square feet of land to be returned to the tax rolls. EXHIBIT: 1. The City Council of the City of Carlsbad, California, does hereby resolve as follows: 1. That all publication and posting notices regarding the proposed vacation of a portion of Pine Avenue between Lincoln Avenue and the ATdtSF iailroad pursuant to Resolution of Intention No. 7791 have been given as required by law. 2. That the City Council did hear the evidence offered by all persons interested in said proposed vacation and does find from all the evidence submitted that a portion of Carlsbad Boulevard in the City of Carlsbad, County ,f San Diego, State of California, particularly described on Exhibit "A" 9 sttached hereto and by this reference incorporated herein, is unnecessary for iresent or prospective street purposes and does hereby make this order vacating 3aid portion of Pine Avenue. 3. That an easement for all existing utilities is excepted from this iacat ion. 4. The City Clerk is instructed to record this Hesolution of Vacation.
