Z 0 6 a =i 0 z 3 0 0 B#m- ITG. 11/27/84 EPT.FNI: TITLE REQUEST FOR AUTHORITY TO ESTABLISH CANNON ROAD AND COLLEGE BOULEVARD ASSESSMENT DISTRICT CITY MGR.- I 3ECOMMENDED ACTION: lirect Staff to prepare documents for the establishment of the Cannon Road and College Boulevard Assessment District conditioned upon the receipt of a petition from Allan Kelly and a deposit by developers in the amount of $80,000.00. ITEM EXPLANATION: Petitions have been received from 51% of the property owners east of El Camino Real to form an assessment district. Upon evaluation, the City's assessment engineer determined that the proposed district might not be marketable because there was no trunk sewer serving the area. To remedy this problem, the district was expanded to include Cannon Road and the sewer line within the road west of El Camino Real to connect to the existing facilities. On November 5, 1984, the Project Review Committee met to consider the project. This committee was set up by Council Policy 33 for the purpose of reviewing proposed assessment districts using 1915 Act bonds and making recommendations to Council. The Committee recommended that the district proceed. Since petitions have not been received from property owners of 60% of the land, the first step will be to prepare documents for a 1931 Act Debt Limit hearing. Prior to start of this work, developers are required to submit a deposit of $80,000 to cover estimated costs of the assessment engineer, legal counsel and staff. It..will take about 14 weeks for the assessment engineer to prepare the Debt Limit Report, send out notices and hold the public hearing on the debt limit. If a majority favor the district and the City Council approves it, plans and specifications will be prepared and the 1913 Act assessment hearing will be held to form the district. The proposed district would include street improvements on Cannon Road from its existing end near 1-5 to the eastern City limits (some full width and some half width), College Boulevard from El Camino Real to Cannon Road, sewer trunk lines and other utilities in the streets and traffic signals at intersections. FISCAL IMPACT: The preliminary estimate of the total project cost is $24,300,000 including $15,600,000 for construction, $2,200,000 for right-of-way, $3,100,000 for incidentals and $3,400,000 for financing. Council Policy 33 requires developers to deposit funds with the City to cover costs of the district. In order to proceed with the Debt Limit hearing, a deposit of $80,000 is required for the following: I Page 2 of Agenda Bill # FISCAL IMPACT (continued) Assessment Engineer Legal Counsel City Staff $65,000.00 $ 5,000.00 A further deposit will be required after the debt limit hearing in order to proceed with the 1913 hearing, prepare and check plans. ENVIRONMENTAL REVIEW: All portions of Cannon Road and College Boulevard within this proposed assessment district are either within an approved master plan or tentative map of a project or are required as an off-site access for a project. Thus the environment a1 reviews for the various projects included all the proposed assessment district. Although Cannon Road from El Camino Real to College Boulevard is not currently required as a condition of any development, it was an alternative considered for the Carlsbad Highlands project. The portion of Cannon Raod from 1-5 to Macario Canyon Park is within the coastal zone and a Coastal Permit will be required. EXHIBITS: 1. Preliminary assessment diagram. 2.
