CITY ~my v TITLE: PLANNING COMMISSION RECOMMENDATION CITY MOR.& cin-)F CARLSBAD - AGENDA~LL RECOMMENDED ACTION: Direct staff to prepare a report addressing whether undevelopable property should be counted in determining permitted density. ITEM EXPLANATION The Planning Commission at its meeting of November 14, 1984 voted unanimously to recommend to the City Council that staff be directed to prepare a report and recommendation analyzing whether the zoning ordinance should be amended especially for planned developments to not allow undevelopable portions of property to be used in calculating permitted density. The idea is to subtract the portions of a property which are undevelopable because of constraints like extremely steep topography or unique environmental resources from the gross acreage upon which the overall density of a project is calculated. Oceanside has already adopted this type of ordinance which is attached for Council review. Staff's report would analyze the impact that this would have on typical projects in Carlsbad. Passed projects would be reviewed as examples. Initial staff thought is that the density of a number of projects would be reduced by about 25%. ENVIRONMENTAL REVIEW None required at this time. FISCAL IMPACT Staff time to prepare report - approximately 20 hours. EXHIBITS 1. Oceanside Ordinance achieve the purpose and intent of this article the following lands shall not be developed: (a) Lands in slopes over 40% with a minimum elevation (b) Riparian corridors or rivers, intermittent or gerennial streams or lakes and their associated vegetation. As a minimum riparian corridors shall include chdnnelways and banks. An exemption may be granted for stream crossings provided streambeds and banks are preserved to the maximum extent possible. It is the policy of the City's Land Use Element of the differential of 25 feet. Section 1401.54: ADDITIONAL INFORMATION REQUIREMENTS. Every application shall be accompanied by such drawings, maps, plans, specifications and graphic or written material as may be required by the Planning Director to describe clearly and accurately the proposed work and its effect on the terrain and existing improvements. The following information shall be submitted to the Planning Department in addition to that which may be required for the subject application (s) by other provisions of the Comprehensive Zoning Ordinance: (a) Slope analysis showing lands in slopes of 20% to 40% and over 40%. I ! l (b) The location of all significant trees or clusters of trees, outcroppings, watercourses, lakes, ponds, and other significant nakural features. (C) An engineering geologic report shall be required on all lands of 20% to 40% slope. This report shall be based on adequate field observations and/or tests prepared by a certified engineering geologist and an onsite soils rtport prepared by a soils engineer registered with the State of California. Reports shall, as Onsite conditions dictate, be prepared in accordance with guidance for practice issued by the California Division of Mines and Geology. (d) Preliminary landscaping plans which show areas to be replanted and areas to remain in a natural state. Preliminary plans shall follow the informational 14.5-2 i I I I I c2d
