PATRICKS CHURCH - JOHN P. LANDRY - APPELLANT DEPT. HD. CITY AT'fY CITY MGR.Z RECOMMENDED ACTION: That the Council reject the appeal and require the developer to extend the storm drain to Pi0 Pico. ITEM EXPLANATION: The appellant is requesting relief of the City Engineer's requirement to extend a storm drain in Tamarack Avenue approximately 200 feet from their west property line to an existing drain in Pi0 Pico. The developer, St. Patricks Church, was required, as a condition of CUP- 204, to install improvements along Tamarack Avenue. To facilitate issuance of a building permit for the church, they were allowed to sign a standard development agreement which referenced an unsigned set ofstreet improvement plans prepared by a private consultant for the widening of Tamarack Avenue. The plans showed the existence of an 18" storm drain but did not show details of its relocation. The development agreement was silent regarding storm drain relocation. Because the street plans did not show the storm drain work, the developer hired an engineer to prepare revised plans. The revised plans proposed to relocate the existing storm drain and to dump the water back out onto the street by means of an outlet structure near the church's west property line. In reviewing this proposal, the Engineering Department determined that the proposed solution was unacceptable and that the storm drain pipe must be extended to tie into an existing drain in Pi0 Pico. Their engineer's estimate of the cost to construct this storm drain is $66,000.00, $18,000.00 more than the first proposal. The developer feels the City should pick up this additional cost. This proposal had an estimated construction cost of $48,000.00. The appeal has been rejected at staff level and referred to the Council. The alternatives are to: 1) require construction of the extension at the developer's expense; 2) allow the developer to dump the water back out onto Tamarack Avenue, and 3) require construction of the extension with the City paying the additional expense. Staff recommends alternative ##I. The second alternative is an unacceptable engineering solution because the flows exceed acceptable limits of street capacity and would expose the City to liability should the flows contribute to an. accident. The third alternative is rejected because no funding source is available and the requirement for the developer to finance necessary offsite improvements is not an unusual situation. The applicant shall prepare a detailed landscape and irrigation plan which shall be submitted to and approved by the Planning Director prior to the issuance of building permits. All landscaped areas shall be maintained in a healthy and thriving condition, free from weeds, trash, and debris. Any signs proposed for this development shall be designed in conformance with the city's Sign Ordinance and shall require review and approval of the Planning Department prior to in- stallation of such signs. Trash receptacle areas shall be enclosed by a 6 foot high masonry wall with gates pursuant to city standards. Loca- tion of said receptacles shall be approved by the Planning Director. All roof appurtenances, including air conditioners, shall be architecturally integrated and shielded from view and the sound buffered from adjacent properties and streets to the satisfaction of the Planning Department and Building Direc- tor. Seven additional parking spaces shall be provided on-site to meet the minimum parking requirements for a church use. Such spaces shall be located subject to the approval of the Planning Director prior to the issuance of a building permit and shall be shown on the reproducible mylar as required by condition no. 5. The height of the church spire shall not exceed 60 feet as measured from the finished floor level of the church. Engineering Department Conditions 13) The developer shall obtain a grading permit prior to the commencement of any clearing or grading of the site. .j 14) The grading for this project is defined as "regular grading" by Section 11.06.170(a) of the Carlsbad Municipal Code. The developer shall submit a grading plan for approval which shall include all required drainage structures and any re- quired erosion control measures. The developer shall also submit soils, geologic or compaction reports if required and shall comply with all provisions of Chapter 11.06 of the Carlsbad Municipal Code. A strip of land approximately 9 feet wide shall be dedicated ' 20-foot property line radius at the intersection with Adams Street and a taper approximately 50 feet long to a width of @ along Tamarack Avenue. The land dedicated shall be subject to the approval of the City Engi- neer and shall be dedicated prior to the issuance of a building permit. ', 16) All land and/or easements required by this project shall be granted to the city, without cost to the city, free and clear of all liens and encumberances. Direct access rights along Tamarack Avenue shall be waived y by deed restriction prior to issuance of a building permit. 9 Tamarack Avenue shall be improved by the developer along the , subdivision frontage based on a centerline to curb face width of 32 feet and in conformance with City of Carlsbad Standards prior to occupancy of any buildings. This condi- tion may be fulfilled by entering into a future improvement agreement prior to the issuance of a building permit if ap- proved by the City Engineer. 19) The developer shall install a wheelchair ramp at the public street corner abutting the subdivision in conformance with City of Carlsbad Standards prior to occupancy of any build- The design of Tamarack Avenue is currently underway and the Ex .precise ings. alignment is not known at this time. Therefore, the improvements required may be revised or delayed by the post- ing of an appropriate bond if such is found necessary and is approved by the City Engineer. 21) The developer shall comply with all the rules, regulations and design requirements of the respective sewer and water agencies regarding services to the project. Parking on Tamarack Avenue along the frontage of this site shall not be permitted.
