LOWERING SPEED LIMIT FROM 45 MPH CITY ATTY
TO 35 MPH ON A PORT ION OF LA COSTA AVENUE CITY MGR.-~--

RECOMMENDED ACTION:
Adopt Ordinance No. a Ii'/ as an urgency measure' establishing a
prime facie speed limit of thirty-five miles per hour on La Costa
Avenue from El Camino Real to a point 1,000 feet easterly.
ITEM EXPLANATION:
The subjecl section of La Costa Avenue is located at the westerly
end of a long downhill run for westbound traffic. As traffic rounds
a curve with short sight distance, it is suddenly confronted with a
number of driveways serving commercial centers on both the north and
south sides of the street.
The combinat.ion of speed, turn movements and cross conflicts has
resulted in 31 accidents over the last 35 months. Eight of those
caused moderate to severe personal injuries. In rainy weather, the
situation is aggravated by poor visibility and reduced traction.
Lowering the speed limit will be one step in a program to make the
street safer. Other possibilities include a raised median to
prohibit left turns and cross movements, and/or advance warning
flashers.
Warning slgns are already in place, and advance speed reduction
signs and 35 MPH speed limit signs will be installed upon adoption
of the ordinance.
The measure is being introduced as an urgency ordinance because of
the need to make immediate provision for the public safety and
welfare, particularly in view of increased holiday season traffic
and expected rainy weather.
FISCAL IMPACT:

AN URGENCY ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF CARLSBAD, CALIFORNIA AMENDING TITLE 10,
SHAPTER 10.44 OF THE CARLSBAD MUNICIPAL CODE BY
THE AMENDMF.NT OF SECTION 10.44.070 TO ADDITIONALLY
SET A PRIMA FACIE SPEED LIMIT OF THIRTY-FIVE MILES
PER HOUR ON A PORTION OF LA COSTA AVENUE.
WHEREAS, a speed limit of forty five mi !es per hour has
8 previously been established on La Costa Avenue; and
9 WHEREAS, an engineering study reveals such a speed limit to
10 be inappropriate on that portion of La Costa Avenue from El Camino
11 Real to a point 1,000 feet easterly; and
12 WHEREAS, during the holiday season traffic will be heavier,
13 weather conditions sometimes unfavorable, and accident risk
14 increased; and
15 WHEREAS, it is thus necessary that this ordinance be
16 effective immediately to protect motorists and pedestrians,
17 THEREFORE, the City Council of the City of Carlsbad,
18 California does ordain as follows:
19 "10.44.070 La Costa Avenue. The prima facie speed limit on
La Costa Avenue from tl Camino Real to a point 1,000 feet easterly
20 is thirty-five miles per hour, and from said point easterly to
Rancho Santa Fe Road is forty-five miles per hour."

This ordinance is hereby declared to be an emergency
ordinance adopted as an urgency measure to protecl the public
health, safety and welfare and shall take effect im:nediately upon
its adoption. The facts constituting the emergency are set forth
above and represent a serious threat to the citizens of Carlsbad.
EFFECT I VE DATE: This ordinance shall be effective
immediately upon passage. The City Clerk of the City of Carlsbad
shall certify to the adoption of this ordinance and cause it to be

published at least once in the Carlsbad Journal within fifteen days
after its adoption.
