HD. & CITY Ally*& CITY MGR.& RECOMMENDED ACTION: It is recommended that the City Council ADOPT Resolution No. 7Pyq , APPROVING the Woolley Reorganization. ITEM EXPLANATION This item is a request by Mr. Roger Woolley for City Counc 1 approval of a reorganization to include the annexation of 473.18 acres of land into Carlsbad, detachment from the Rancho Santa Fe Fire Protection District, County Service Area No. 83 (San Dieguito Local Parks), and County Service Area No. 17 (San Dieguito Paramedics). The property is located south of Olivenhain Road near the Rancho Santa Fe Road intersection. The property was prezoned to R-10,000, R-1-15,000, R-1-25,000, R-l- 40,000 and 0-S by the City Council on June 21, 1983. On October 1, 1984,the Local Agency Formation Commission adopted a Resolution of Reorganization for this property. A copy of this resolution is attached for your review. Also, on November 13, 1984, the City Council adopted a resolution initiating the proceedings for the Woolley Reorganization. The last remaining discretionary action to complete the reorganization is the adoption of a Resolution of Reorganization by the City Council. Approval of this reorganization would be consistent with the City Council's annexation policy. ENVIRONMENTAL REVIEW The City Council has certified an environmental impact report for a general plan amendment and zone change on the subject property on June 21, 1983. A copy of the environmental documents is on file in the Land Use Planning Office. FISCAL IMPACT The reorganization of this property will generate additional revenue from property taxes which should offset the cost of providing public services to the site. EXHIBITS 1. WOOLLEY REORGANIZATION I1 WHEREAS, an application for approval of a proposal for the initiation of proceedings for the reorganization of territory hereinafter indentif ied and described as Woolley Reorganization I1 to the City of Carlsbad, County of San Diego, State of California, was filed with the Local Agency Formation Commission Reference No. RO 84-20; and WHEREAS, a resolution of the said Local Agency Formation Commission, after a hearing held in the manner required by law, was duly passed and adopted on the 1st day of October, 1984, approving the application for reorganization of the territory hereinafter described by metes and bounds; and WHEREAS, said resolution provided that said reorganization was approved following notice and hearing and further provided that the City Council of the City of Carlsbad was authorized to annex said territory following notice and hearing by said Council ; WHEREAS, a written petition containing the required signatures and a description of the uninhabited territory hereinafter described has been presented to the Local Agency Formation Commission requesting reorganization under the District Reorganization Act of 1965; and 3 I f 1 1 2 3 a 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 WHEREAS, said petition was certified sufficient by the Executive Officer of LAFCO on September 20, 1984; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, California, as follows: 1. That the above recitations are true’and correct. 2. That said petition contains a description of certain uninhabited territory sought to be included and annexed to the City of Carlsbad and detached from the Leucadia County Water District, Encinitas Fire Protection District, and County Service Areas No. 17 and No. 83, that said petition is signed by the owners of not less than 25% of the land in the territory by area and by assessed value as shown on the latest equalized assessment roll of the County of San Diego, in which county the City of Carlsbad is situated. 3. That the City Council hereby declares that a public hearing on the proposed reorganization was held on December 18, 1984, and at that hearing, all interested parties were heard. 4. That the territory proposed to be annexed to the City is uninhabited territory as defined by Section 35038 of the Government Code and is contiguous to the boundaries of the City. 5. That the aforementioned uninhabited territory included in the proposed reorganization is hereby designated and shall hereafter be known as the Woolley Reorganization 11. 6. That all requirements of law necessary to the adoption of this resolution approving the reorganization of certain uninhabited territory pursuant to the provisfons of the District Reorganization Act of 1965, have been complied with. 8. That it does hereby approve the annexation to the City of Carlsbad and the detachment from the Rancho Santa Fe Fire Protection District, and County Service Areas No. 17 and No. 83 of that certain real property located in the County of San Diego, State of California, designated as the Woolley Reorganization I1 and more particularly described on Exhibit "A" attached hereto and made a part hereof. NO.: R084-20 RESOLUTION OF THE SAN DIEGO LOCAL AGENCY FORMATION COMMISSION APPROVING A PROPOSED REORGANIZATION INCLUDING ANNEXATION TO THE CITY OF CARLSBAD AND DETACHMENTS FROM THE RANCHO SANTA FE FIRE PROTECTION DISTRICT, COUNTY SERVICE AREA NO. 83 (SAN DIEGUITO LOCAL PARKS), AND COUNTY SERVICE AREA NO. 17 (SAN DIEGUITO PARAMEDICS) t'Woolley Reorganization 11" On motion of Commissioner Eckert, seconded by Commissioner oravec, the following resolution is adopted: WHEREAS, a petition was submitted to this Commission for the reorganization of territory including annexation to the City of Carlsbad and detachment from the Rancho Santa Fe Fire Protection District, which petition was certified sufficient by the Executive Officer on September 20, 1984; and WHEREAS, the territory proposed for reorganization is as described in the application on file with the Local Agency Formation Commission; and WHEREAS, pursuant to Government Code Section 56262, the Executive Officer of this Commission set a public hearing on the proposed reorganization for October 1, 1984, and gave notice of the date, time, and place of said hearing in accordance with Government Code Sections 56264 and 56265; and WHEREAS, the Executive Officer of the Commission has filed her report on said reorganization, which report was received and considered by the Commission; NOW THEREFORE, BE IT RESOLVED, that this Commission hereby finds, determines, and orders as follows: (1) The hearing was held on the date set therefor, and due notice of said hearing was given in the manner required by law. (2) At that hearing the Commission called for, heard, and considered all interested parties and read and considered the report of the Executive Officer. (3) The Commission adopts, pursuant to Section 15091 of the State CEQA Guidelines, the mitigation measures included in the resolution of approval of the City of Carlsbad for the impacts identified, and certifies that the mitigation is within the jurisdiction of the City and not LAFCO because the affected resources and services will be within the city's sphere of influence and within the city limits upon annexation. (4) The Commission certifies that there are no agricultural preserves within the reorganization territory, but that the area does include prime agricultural land. Determine, however, that approval Of the proposal would not significantly affect the County's agricultural resources and denial of the reorganization to promote long-term agricultural production in this area would be counter to logical and orderly urban development p-atterns. (5) The Commission hereby approves the reorganization with modified boundaries, as described in Exhibit "A" attached hereto, subject to the following condition: The territory owned by the Olivenhain Municipal water District shall be prezoned by the City of Carlsbad prior to completion of proceedings (Government Code Section 54790 (a) (3). _. (6) The approved reorganization includes the following actions : a) Annexation to the City of Carlsbad; b) Detachment from the Rancho Santa Fe Fire Protection District; c) Detachment from County Service Area No. 83 (San Dieguito Local Parks); and d) Detachment from County Service Area No. 17 (San Dieguito Paramedics). (7) The boundaries of the territory as described in Exhibit "A" are definite and certain. (8) The boundaries of the territory do conform to lines of assessment and ownership. (9) The territory includes 476.78 acres and is uninhabited. (10) The territory proposed to be reorganized is hereby designated the "Woolley Reorganization 11" (City of Carlsbad) . (11) The Commission hereby designates the City of Carlsbad as the conducting authority and authorizes the City Council to initiate proceedings in compliance with this resolution. (WOOLLEY REORGANIZATION 11) WHEREAS, pursuant to the District Reorganization Act of 1965, commencing with Section 56000 of the Government Code, a petition of application was submitted to the Local Agency Formation Commission and certified sufficient by the Executive Officer on September 20, 1984; and WHEREAS, on October 1, 1984, the Local Agency Formation Commission by Resolution (attached hereto as Exhibit l), approved the proposed reorganization and authorized the Council of the- City of Carlsbad to initiate and conduct proceedings for the proposed reorganization in compliance with said resolution and pursuant to Government Code Section 56000, et seq.; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, California, as follows: 1. That the above recitations are true and correct. 2. That the City Council hereby adopts this resolution initiating proceedings for the proposed reorganization as provided in Government Code Section 56310 as follows: a. The name of the areas for which any change of organization if proposed is entitled Woolley Reorganization 11. The reorganization consists of the territory described in Exhibit llA1l to the Local Agency Formation Commission Resolution. b. Preliminary proceedings were commenced when the petition by the landowners was submitted to the Local Agency Formation Commission making a proposal for this annexation. e. The territory includes 476.78 acres and is uninhabited. f. The reasons for the proposed reorganization are: (1) Applicant is proposing development on the property and the City of Carlsbad is the appropriate agency for providing public services. (2) The territory is a county island and the annexation would be consistent with the City of Carlsbad Sphere of Influence. (3) The annexation is consistent with the City of Carlsbad and Local Agency Formation Commission policies on annexation of county islands. g. The Clerk of the City of Carlsbad is hereby directed to advertise the proposed annexation for public hearing on December 18, 1984, at 6:OO P.M., in the Council Chambers. h. Any interested person desiring to make written protest against said reorganization shall do so by written communication filed with the Clerk of the City of Carlsbad not later than the hour above stated for the public hearing. A written protest by a landowner shall contain a description sufficient to identify the land owned by him; a protest by a voter shall contain the residential address of such voter. i.
