RECOMMENDED ACTION:
Mayor Casler recommends that Resolution No. 787 / be adopted approving
the Seventh Amendment to the San Diego Association of Governments
Joint Powers Agreement.

SUBJECT: Joint Powers Agreement Amendments
On December 18th the County Board of Supervisors unanimously voted to rejoin
SANDAG based upon agreements reached between the Board of Supervisors and
the SANDAG Board which provide that the County, as a member agency, will have
an extraordinary vote on a limited number of items which are recognized as being
the specific and exclusive responsibility of the County under State statutes. The
SANDAG Board reviewed these special items under the weighted vote procedure
already contained in the JPA and unanimously supported the agreements.
These agreements can only be implemented by amending the SANDAG JPA. The
proposed amendments, which must be approved by all cities to be effective, would
do the following:
1. Amend Section 8(d) of the JPA to provide that a 60% weighted vote of
member agencies of SANDAG would be required to supersede the position
taken by the County with regard to specified federal categorical grant pro-
grams subject to clearinghouse review, and with regard to other matters
which axe statutorily subject to the specific and exclusive jurisdiction of the County within the region.
2. Further amend Section 8(d) of the JPA by updating the listing of federal
categorical grant programs for which the 60% weighted vote procedure would
apply, and by transferring that listing from the JPA to the Bylaws. The
Bylaws would then be amended to include the listing of federal categorical
grant programs referenced above, as well as a listing of the non-grant topics
for which the provisions of the first amendment referenced above would
apply
As mentioned, the proposed changes to the JPA will require a unanimous vote of
the member agencies of SANDAG. The proposed Bylaw changes will require a
simple majority vote of the Board of Directors which will take place after all
member agencies approve the JPA Amendments,
We request that your city consider this matter at your next council meeting, since
the County desire to participate in SANDAG as soon as possible. Attached to this
memo is a sample resolution you may wish to use for that purpose (minute action
is also acceptable to SANDAG) and also a copy of the proposed amendments to the
JPA and the Bylaws. SANDAG staff will be available to make a presentation to
your council on this item or attend to answer questions at your request. Please
contact me or Debra Greenfield or Ken Sulzer at 236-5300 if you have any
questions or would like us to attend your meeting.

2. Proposal to add a new Subsection 8(e) to the SANDAG JPA as follows:
e. The voting procedure prescribed by Section 8(d) of the Joint Powers
Agereement may be invoked with respect to other matters if, and only if,
such other matters are, pursuant to State law, specifically and exclusively the
responsibility of the County of San Diego within its boundaries. Article VII
Section 2 of the Bylaws lists those other matters subject to the voting
procedure prescribed by Section 8(d).

For all matters listed in Section 2 of this Article relating to land use or
transportation issues, the County of San Diego shall, as appropriate, request
that SANDAG provide planning and research assistance to aid the County in
carrying out its state-mandated responsibilities.

A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF CARLSBAD, CALIFORNIA APPROVING
THE SEVENTH AMENDMENT TO THE
SAN DIEGO ASSOCIATION OF GOVERNMENTS
JOINT POWERS AGREEMENT.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
I City of Carlsbad, California, as follows:
1. The Mayor is hereby authorized and directed to execute
~ that certain Seventh Amendment to the Joint Powers Agreement of
the San Diego Association of Governments.
PASSED, APPROVED, AND ADOPTED at a regular meeting of the
City Council of the City of Carlsbad held on the 8th day of
January, 1985, by the following vote, to wit:
