TITLE: INTERIM PLANNING POLICIES CA LAND USE ELEMENT REVIEW RECOMMENDED ACTION: If Council concurs your action is to adopt Resolution No. 787X ITEM EXPLANATION The City Council at your meeting of January 2, 1985 directed the preparation of a resolution adopting interim planning policies during the General Plan Land Use Element review. Thc resolution is attached. It provides that applicants for all development projects be requested to agree to extend the time limits for review and action on a project. WHEREAS, the City Council has determined a need tc review the Land Use Element of the City's General Plan to t that the element establishes the general distribution, locz and extent of land uses; and the desired standards of popul density and building intensity necessary to ensure that Car develops as a high quality community which provides superic economic, social, aesthetic and environmental benefits and opportunities to present and future residents and business6 WHEREAS, a comprehensive review of the Land Use El is necessary to ensure the health, safety and welfare of a1 present and future residents of the City; and I WHEREAS, a comprehensive review of the Land Use El will give the residents, developers and business people confidence that the City of Carlsbad will develop accordin9 well established, carefully considered plan: and I I ' WHEREAS, a comprehensive review of the Land Use El is necessary to ensure that the City is developing in a mar which is consistent with the desires of the community, givj consideration to the mandates of law; and WHEREAS, the Council desires maximum community inp and has therefore established a Citizen's Committee to revi the Land Use Element of the General Plan; and WHEREAS, the Council desires that the review be accomplished as quickly as possible; and 1 2 3 4 5 6 7 8 9 10 11 12 a rn m 13 28 gs % 2058 15 OE$& "=Ha $;$J zwo0- ~zoa 16 oa2m ZO '? 0 gL3z owa 141 '5 a a 17 >o 0 t 18 19 w e WHEREAS, the Council desires that the professional planning staff of the City devote a significant amount of j time to the review of the Land Use Element; and WHEREAS, the Council finds that it is necessary tc establish interim planning policies to expedite the review the Land Use Element, NOW, THEREFORE, BE IT RESOLVED by the City Council the City of Carlsbad, California as follows: 1. That a Citizen's Committee to review the Land Element is established. The Committee shall be composed of sufficient number of persons to represent various viewpoint throughout the community as the Council in its discretion determines. 2. The Citizen's Committee shall review the Land Element as directed by the City Council and shall make a m report to the City Council by July 2, 1985. 3, The City Manager, Director of Building and Plz I ' and the Land Use Planning Manager are directed to give the Use Element review top priority in the scheduling of the wc program of the Land Use Planning Office. Applications for commercial, industrial, e residential projects less than 50 units which do not requir changes to any land use regulations and do not involve significant planning or environmental issues as determined Land Use Planning Manager shall receive third priority. d. Applications for residential projects over units, or commercial, industrial or residential projects wk require changes to any land use regulation or involve signi planning or environmental issues, as determined by the Lanc Planning Manager, shall receive last priority. 4. The following planning policies shall apply du the review period: a. No residential development projects shall approved above the mean density of the General Plan range i there are traffic or circulation impacts which cannot be mitigated. b. In order to ensure that the Land Use Element i completed by the scheduled deadline applicants for all development projects shall be requested to agree to extend time limits for review and action on a project. The agreem shall be in the form shown on Exhibit A to this resolution shall be submitted with the application for the project. 6. This resolution shall be binding on all decisi ' making bodies which exercise decision making authority on 1 use projects. 7. This resolution shall be effective as of Janua 1985 and shall expire on July 2, 1985 unless extended by th ~ Council or or before July 2, 1985. I 8. A copy of this resolution shall be given to ea I applicant for a development project. 9 . Because the following projects were scheduled Planning Commission or City Council hearing prior to the ad of this resolution the projects shall be exempt from this resolution. RAUTENKRANZ, City2lerk -5- I 0 e AGREEMENT TO EXTEND TIME LIMITS TO ALLOW REVIEW OF THE LAND USE ELEMENT OF THE GENERAL PLAN In a desire to assist the City of Carlsbad to expeditiously review the Land Use Element of the General Plan ar to ensure full and adequate review of the application for this development project the undersigned agrees that the time limits imposed by law to approve or disapprove this application shall 0 extended. If a negative declaration is adopted for this project the undersigned agrees that the time period for approval or disapproval is extended for 90 days. If the project requires an environmental impact report the undersigned agrees that the time limit imposed by Section 21 151.5 of the Public Resources Code is extended for six months and that the project shall be approved o disapproved within 90 days after the certification of the environmental impact report , The undersigned understands that t City will process this application according to City Council Resolution No, 7872 and consents to processing the applicat according to that resolution.
