TITLE PUBLIC HEARING FOR STREET DEPT. HD.
VACATION OF A PORTION OF ELM AVENUE
AND A PORTION OF APPIAN ROAD.
RECOMMENDED ACTION:
Adopt Resolution No. 7f69 declaring the intention to vacate
a portion of Elm Avenue and a portion of Appian Road and setting
a public hearing for January 22, 1985.
ITEM EXPLANATION:
The application of Minor Subdivision No. 493 intended to abandon
portions of Elm Avenue and Appian Road. Formal vacation
proceedings were inadvertently overlooked.
Utility companies have been notified of the vacation.
Full street improvements are in place and no conditions need be
imposed.
FISCAL IMPACT:
Approval of this vacation will result in approximately 21,000
square feet of land to be returned to the tax rolls.

RESOLUTION NO. 7869
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF CARLSBAD, CALIFORNIA, DECLARING
ITS INTENTION TO VACATE A PORTION OF
ELM AVENUE AND A PORTION OF APPIAN ROAD.
The City Council of the City of Carlsbad, California, does hereby
resolve as follows:
1. The City Council of the City of Carlsbad hereby declares its
intentions to proceed, under the provisions of Public Streets, Highways,
and Service Easement Vacation Law of 1981, to vacate a portion of Elm
Avenue and a portion of Appian Road located in the City of Carlsbad, County
of San Diego, State of California, particularly described on Exhibit 2.
2. A public hearing shall be held at the City Council Chambers at
1200 Elm Avenue, Carlsbad, California, at 6:OO P.M., January 22, 1985 for
the purpose of hearing all persons interested in or objecting to said
proposed vacation.
PASSED, APPROVED AND ADOPTED at a regular meeting of the Carlsbad
City Council held on the 8th day of January , 1985, by the
following vote, to wit:
AYES: Council Wrs Casler, Lewis, Kulchin, Chick and Pettine
NOES: None
ABSENT: None
