TITLE
RECOMMENDED ACTION:
Adopt Resolution No. 7PrS/accepting bids and awarding Contract No, 3169 for the
construction of the Carlsbad Boulevard Storm Drain to Thibodo Construction.
ITEM EXPLANATION:
On November 20, 1984, Council authorized the advertisement for bids for said
project. Nine sealed bids were received on January 2, 1985, as follows:

1830-3169 for this project.

RESOLUTION NO. 7875
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD,
CALIFORNIA, ACCEPTING BIDS AND AUTHORIZING THE EXECUTION
OF CONTRACT NO. 3169 FOR CONSTRUCTION OF THE CARLSBAD
BOULEVARD STORM DRAIN.
WHEREAS, bids have been received by the City of Carlsbad for the Carlsbad
Boulevard Storm Drain, Contract No. 3169; and
WHEREAS, the low bid received for the contract was submitted by Thibodo
Construction, in the amount of $131,099.70; and
WHEREAS, funds are available in Account No. 330-1830-3169 for this
project ;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad
as follows:
1. The above recitations are true and correct.
2. The bid of $131,099.70 by Thibodo Construction for Contract No. 3169
for the construction of the Carlsbad Boulevard Storm Drain is hereby accepted,
and the Mayor and the City Clerk are hereby authorized to execute a contract
thereafter.
PASSED, APPROVED AND ADOPTED by the City Council of the City of Carlsbad
at a regular meeting held the 15tbday of JanUary , 1985, by the following
vote, to wit:

CARLSBAD BOULEVARD STORM DRAIN - CONTRACT NO- 3169
On January 15, 1985, the City Council awarded you the subject contract.
Enclosed are four (4) copies of the contract documents which should be executed
by you. Please return all copies within twenty (20) days for signature by the
City. Do not date the contract when you sign it; this will be done when the
contract is signed by the City. The bond forms (labor- and material, and
performance) should be completely filled out and executed by you and your
surety .
You must submit evidence of Comprehensive General and Automobile Liability
insurance, including coverage for completed operations. The certificates
submitted must include the following:
1. The City of Carlsbad is to be named as an additional insured on the
comprehensive general liability insurance.
2. The limits of coverage should not be less than $500,000 combined single
limit.
3. Policies shall be endorsed as follows:
"It is hereby understood and agreed that the policy to which this
Certificate refers may not be cancelled, materially changed, nor the
amount of coverage thereof reduced until thirty (30) days after receipt of
written notice of such cancellation or reduction in coverage by the City
Clerk of City of Carlsbad. Coverage under this policy shall be primary
and non-contributing with any other insurance available to the City of
Carlsbad. "

In addition to evidence of liability insurance, the City requires a Certificate
showing current coverage for Worker's Compensation.
Section 3800 of the Labor Code shall be complied with by securing, paying for
and maintaining, in full force and effect for the duration of the contract,
complete workers compensation insurance. You must also furnish a certificate of
insurance evidencing proof of such insurance.
Payments on this contract will be in accordance with Section 9-3 of the latest
edition of Standard Specifications for Public Works Contracts.
Two (2) fully executed copies of the contract will be returned to you for your
files and those of your surety.
A Preconstruction Conference will be scheduled as soon as all contract documents
have been executed.
