Approve Encroachment Permit subject to certain conditions.
ITEM EXPLANATION:
Required public improvements of Carlsbad Tract 81-44 ('5
Avenue, Carlsbad Boulevard and Tamarack Avenue) abut unim
land which has an elevation difference of 0 - 4'. The app
has requested an encroachment permit to allow a tran
retaining wall 0 - 4' tall to retain the soil adjacent to
improvements. The applicant also proposes to construct a
foot chain link fence on top of this retaining wall for
safety* The Carlsbad Municipal Code requires Council apprc

Applicant shall post a cash deposit sufficient to guarant
removal of the retaining wall and chain link fence, wh
