HD.~T~-!( ENCROACHMENT PERMIT CITYATTY fi p CITY MGR.& RECOMMENDED ACTION: Approve Encroachment Permit subject to certain conditions. ITEM EXPLANATION: Required public improvements of Carlsbad Tract 81-44 (Sequoia Avenue, Carlsbad Boulevard and Tamarack Avenue) abut unimproved land which has an elevation difference of 0 - 4'. The applicant has requested an encroachment permit to allow a transition retaining wall 0 - 4' tall to retain the soil adjacent to these improvements. The applicant also proposes to construct a three foot chain link fence on top of this retaining wall for public safety. The Carlsbad Municipal Code requires Council approval of above ground encroachment permits. CONDITION OF APPROVAL: Applicant' shall post a cash deposit sufficient to guarantee the removal of the retaining wall and chain link fence, when the adjacent property develops.
