RECOMMENDED ACTION:
Approve Encroachment Permit subject to certain conditions.
ITEM EXPLANATION:
Required public improvements of Carlsbad Tract 81-44 (Sequoia
Avenue, Carlsbad Boulevard and Tamarack Avenue) abut unimproved
land which has an elevation difference of 0 - 4'. The applicant
has requested an encroachment permit to allow a transition
retaining wall 0 - 4' tall to retain the soil adjacent to these
improvements. The applicant also proposes to construct a three
foot chain link fence on top of this retaining wall for public
safety. The Carlsbad Municipal Code requires Council approval of above ground encroachment permits.
CONDITION OF APPROVAL:
Applicant' shall post a cash deposit sufficient to guarantee the
removal of the retaining wall and chain link fence, when the
adjacent property develops.
FISCAL IMPACT:
None, removal of this retaining wall will be the responsibility
of the applicant.

An encroachment for retaining wall construction over, and across a 2.00 foot strip of land in a public street
right-of-way (Sequoia Avenue) lying Westerly of the following described line:
Commencing at the most southeasterly corner of Lot 1 of Carlsbad Tract 82-44, in the City of Carlsbad, County of
San Diego, State of California, according to Map thereof No. 10872, filed in the Office of the county Recorder of
said County, February 29, 1984; thence along the prolongation of the Southeasterly line of said Lot South 34°33r59" East,
5.00 feet.
