AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA, AMENDING TITLE 21 OF THE
CARLSBAD MUNICIPAL CODE BY AMENDING THE ZONING MAP
FOR A ZONE CHANGE FROM R-A-10,000 TO CT-Q ON
PROPERTY GENERALLY LOCATED EAST OF 1-5 BETWEEN
CAR COUNTRY AND PEA SOUP ANDERSEN'S MOTEL.

The City Council of the City of Carlsbad, California, does
>rdain as follows:
SECTION 1: Title 21 of the Carlsbad Municipal Code is
imended by the amendment of a zoning map for a zone change from R-
4-10,000 to CT-Q on property as shown on the map marked 2C-322,
3xhibit "A", attached hereto and made a part hereof.
SECTION 2: This project is approved upon the express
zondition that the applicant shall pay a public facilities fee as
required by City Council Policy No. 17, dated August 29, 1979, and
amended on April 2, 1982, on file with the City Clerk and
incorporated herein by reference, and according to the agreement
executed by the applicant for payment of said fee a copy of that
agreement dated August 17, 1984, is on file with the City Clerk and
incorporated herein by reference.

A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
CARLSBAD, CALIFORNIA, RECOMMENDING APPROVAL TO THE CITY
PROPERTY GENERALLY LOCATED EAST OF 1-5 BETWEEN CAR COUNTRY
AND PEA SOUP ANDERSEN'S MOTEL.

COUNCIL FOR A ZONE CHANGE FROM ~-~-10,000 TO CT-Q ON
WHEREAS, a verified application for certain property, to
uit:
Parcels 1 and 2 of Parcel Map No. 11284 recorded in the Office of the County Recorder of San Diego County May 11, 1981 as File No. 81-145557, being a portion of Lot H of Rancho Agua Hedionda, according to Map thereof No.
823,
has been filed with the City of Carlsbad, and referred to the
Planning Commission; and
WHEREAS, said application constitutes a request as
provided by Title 21 of the Carlsbad Municipal Code; and
WHEREAS, the Planning Commission did on the 12th day of
Iecember, 1984, hold a duly noticed public hearing as prescribed by
law to consider said request; and
WHEREAS, at said public hearing, upon hearing and
aonsidering all testimony and arguments, if any, of all persons

1-5 between Car Country and Pea Soup Andersen's.
RECOMMENDATION
It is recommended that the Planning Commission ADOPT Resolution
No. 2390 recommending APPROVAL of 2C-322 to them Council based on the findings and subject to the conditions contained
therein.
I1 0 PROJECT DESCRIPTION
The applicant is requesting that the zoning of the above
mentioned parcel be changed from R-A-10,000 to CT-Q. A visitor center/Chamber of Commerce building was recently approved on the southerly portion of the property. The residual portions of the
property will remain vacant at this time but, in the future, may accommodate commercial-tourist types of uses.
111. ANALYSIS
Planning Issues .
1) Is the proposed CT-Q zone consistent with the TS General Plan designation?
2) Is the proposed CT-Q zone and the uses allowed within this zone consistent with surrounding zoning and land
uses?
Discussion
The recent amendment of SDP 80-11(B) for the Pea Soup Andersen's
Visitor CeMer necessitated the realignment of Paseo del Norte
to straighten out the existing broad curve and substandard roadway. This resulted in an R-A-10,000 island between the new
roadway alignment and the visitor center.
At this location, Paseo del Norte has been indicated by the General Plan as the dividing line between the land use
designation of Travel Services to the west and Non-Residential Reserve to the east. Staff feels the realignment of Paseo del Norte is only a minor modification to the General Plan.
