Ss O§J O 8 RECOMMENDED ACTION: Adopt Resolution No. 7^9-3. authorizing Carlsbad Raceway and northerly portion of Carrzllo Estates to participate in an assess- ment district being sponsored by the City of Vista. ITEM EXPLANATION: The Carlsbad Raceway and the property between the raceway and Palomar Airport Road will be sewered by a line which goes through a portion of the City of Vista and then back into Carlsbad connect- ing to a future line paralleling the south Agua Hedionda Creek. The City of Vista is forming an assessment district for those properties in the raceway basin within Vista city limits. It would be possible for those parcels within the City of Carlsbad to tempo- rarily be served through Vista's line. The request at hand is for the City of Carlsbad to authorize land within its corporate limits to participate in Vista's proposed assessment district. Staff is recommending that this authorization be given. Permanent sewer service will be provided by the City of Carlsbad to these properties FISCAL IMPACT: Fees required to participate in Vista's assessment district will be forwarded by the Carlsbad property owners involved. EXHIBIT RESOLUTION NO. 1 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, AUTHORIZING 2 PARTICIPATION IN THE CITY OF VISTA ASSESS- MENT DISTRICT. 3 4 WHEREAS, properties at the east Carlsbad city limits north of 5 Palomar Airport Road can be temporarily served through the proposed 6 Vista sewer lines; and 7 WHEREAS, the participation of the affected parcels requires 8 approval by the City Council of Carlsbad; and 9 WHEREAS, representatives of the landowners of the affected 10 parcels have requested the City of Carlsbad to grant permission 11 to participate in the assessment district; 12 NOW, THEREFORE, BE IT RESOLVED by the City Council of the 13 City of Carlsbad as follows: 14 l. That the above recitations are true and correct. 15 2. We were informed by representatives of the City's that both Carlsbad and Vista officials have met numerous times to develop a master plan for sewering this area. Due to the topography and physical setting of the subject properties, sewering into Vista becomes necessary. Owners within the Raceway Basin have requested the City of Vista to consider the formation of an assessment district for financing roads, sewer, water and essential infrastructure necessary to support develop- ment in the 1200 acre Raceway Basin area. Since the subject 211 acre property would be a logical part of any sewer assessment district, and because the City of Vista would act as "lead agency", it is necessary to have Carlsbad's consent to cooperate. We, therefore, submit this letter requesting the City of Carlsbad to grant permission for Carlsbad Raceway and Carrillo Rancho Partnership properties to participate in the proposed City of Vista Assessment District. Vista officials have indicated a desire to continue working with your staff to create a cost effective and more regionally beneficial sewer collection system. It is understood that a flow conveyance agreement between both cities must be acquired under future separate action. This will be accomplished after system design engineering and more information is available. We are advised that your office will present this request for consent in cooperation to Carlsbad City Council on Tuesday, January 15, 1985. Since time required in starting the engineering work is now crucial, your prompt scheduling is greatly appreciated. Please notify the undersigned as to the decision of the Council.
