ITEM EXPLANATION: A request to vacate a 17 foot wide public street easement on a portion of Park Drive was made by Pete Peters, owner of the property. The area to be vacated is presently an unsightly drainage ditch which the owner plans to beautify, and then improve the property. Staff has reviewed the request and concluded that the excess street right-of-way is not needed for the ultimate street widening. At one time, the street was classified as a secondary arterial calling for an 84 foot right-of-way. However, it has been reclassified as a collector, thus the excess right-of-way is not needed, and it would be better to put it into productive private use. Full street improvements are in place on both sides of the street with the result that following this street vacation, there will be a 48 foot curb-to-curb width, in a 67 foot right-of-way. Utility companies have been notified of the vacation. There are no known utility easements on the property. FISCAL IMPACT: Approval of this vacation will result in approximately 3,300 square feet of'land to be returned to the tax rolls. The City Council of the City of Carlsbad, California, does hereby resolve as follows: 1. The City Council of the City of Carlsbad hereby declares its intention to proceed, under the provisions of Public Streets, Highways, and Service Easement Vacation Law of 1981, to vacate a portion of Park Drive between Adams Street and Calavo Court, located in the City of Carlsbad, County of San Diego, State of California, particularly described on Exhibit "A". 2.
