RECOMMENDED ACTION:
Adopt Ordinance 2)fi as an urgency measure requiring vehicles on
Poinsettia Lane to stop before entering Paseo del Norte and before entering
Batiquitos Drive; and requiring vehicles on Batiquitos Drive to stop before
entering Poinsettia Lane. (Vehicles on Paseo del Norte are already
required to stop before entering Poinsettia Lane.)
ITEM EXPLANATION
Poinsettia Lane, Paseo del Norte, and Batiquitos Drive are all arterial
streets in the Circulation Element of the General Plan.
Residential development is taking place rapidly along Poinsettia Lane to
the east of 1-5. Additionally, Poinsettia is currently being constructed
westerly, over the railroad to connect with Carlsbad Boulevard.
Traffic volumes and accidents are increasing, and there is motorist
confusion because the north roadway of Poinsettia between Paseo del Norte
and Batiquitos has been kept closed during development construction. The
requested four-way stops will permit the roadway to be opened. Permanent
signing and striping can then be installed, and the system made to work in
an orderly fashion.
Both intersections are to be signalized when warrants are met, which is
likely to occur within the next eighteen months.
The measure is being introduced as an urgency ordinance because of the need
to make immediate provision for the public safety and welfare. Five
traffic accidents have occurred during the past year.
FISCAL IMPACT
The cost of signing, striping and pavement markings is estimated at
$1,000.00.

AN URGENCY ORDINANCE OF THE CITY COUNCIL OF THE CITY OF - CARLSBAO, CALIFORNIA, AMENDING TITLE 10, CHAPTER 10.28 OF
THE CARLSBAD MUNICIPAL CODE BY THE AMENDMENT OF SECTION
10.28.321 REQUIRING BATIQUITOS DRIVE TO STOP FOR POINSETTIA
LANE; ADDING SECTION 10.28.323 REQUIRING POINSETTIA LANE
TO STOP FOR PASEO DEL NORTE; AND ADDING SECTION 10.28.325
REQUIRING POINSETTIA ,LANE TO STOP FOR BATIQUITOS- DRIVE.
WHEREAS, Paseo del Norte has previously been required to stop for
Poinsettia Lane; and
WHEREAS, an engineering study reveals that additional stop controls on
Poinsettia Lane are essential to public safety and efficient traffic flow;
and
WHEREAS, traffic accidents are occurring and traffic volumes are
increasing daily; and
WHEREAS, it is thus necessary that this ordinance be effective
immediately to protect motorists and pedestrians,
NOW, THEREFORE, the City Council of the City of Carlsbad, California,
does ordain as follows:
SECTION 1: That Title IO, Chapter 10.28 of the Carlsbad Municipal Code
is amended by the amendment of Section 10.28.321 to read as follows:
"10.28.321 Poinsettia Lane. Drivers shall stop where the following
described streets intersect Poinsettia Lane:
Paseo del Norte
Batiquitos Drive"
SECTION 2: That Title IO, Chapter 10.28 of the Carlsbad Municipal Code
is amended by the addition of Section 10.28.323 to read as follows:
"10.28.323 Paseo del Norte. Drivers shall stop where the following
described street intersects Paseo del Norte:
Poinsettia Lane"
SECTION 3: That Title IO, Chapter 10.28 of the Carlsbad Municipal Code
is amended by the addition of Section 10.28.328 to read as follows:
V0.28.325 Batiquitos Drive. Drivers shall stop where the following
decribed street intersects Batiquitos Drive:
Poinsettia Lane"

This ordinance is hereby declared to be an emergency ordinance adopted
as an urgency measure to protect the public health, safety and welfare and
shall take effect immediately upon its adoption. The facts constituting
the emergency are set forth above and represent a serious threat to the
citizens of Carlsbad.

EFFECTIVE DATE: This ordinance shall be effective immediately upon
passage. The City Clerk of the City of Carlsbad shall certify to the
adoption of this ordinance and cause it to be published at least once in
the Carlsbad Journal within fifteen days after its adoption.
INTRODUCED, PASSED, APPROVED AND ADOPTED at a regular meeting of said
City Council held on the 5th day of February , 1965, by the
following vote, to wit:
