Trdk PUBLIC HEARING FOR TITLE: STREET VACATION OF A CITY A PORTION OF CARLSBAD BOULEVARD CITY MOR.-% RECOMMENDED ACTION: Adopt Resolution No. 90 declaring the intention to vacate a portion of Carlsbad Bou%vard between Sequoia Avenue and Chinquapin Avenue and setting a public hearing for 6:OO P.M., Tuesday, March 5, 1985. ITEM EXPLANATION: A request to vacate a public street right-of-way on a portion of Carlsbad Boulevard was made by Gemini Development Corporation, owner of the property. Staff has reviewed the request and concluded that the excess street right-of-way is not needed for any foreseeable street widening. The improvements proposed as part of the project will align the curb and gutter so as to meet the roadway improvements of the Aqua Hedionda Bridge replacement. Utility companies have been notified of the vacation and the street vacation resolution will specify that any existing utility easements will remain. The resolution will also specify that the street vacation shall not be recorded by the City Clerk until the street improvements have been constructed, or funds therefor deposited with or guaranteed to the City. FISCAL IMPACT: Approval of this vacation will result in approximately 2,100 square feet of land to be returned to the tax rolls. EXHIBITS: 1.d Location Map. 2. Street Vacation Plat. 3." The City Council of the City of Carlsbad hereby declares its intention to proceed, under the provisions of Public Streets, Highways, and Service Easement Vacation Law of 1981, tg vacate a portion of Carlsbad Boulevard between Sequoia Avenue and Chinquapin Avenue, located in the City of Carlsbad, County of San Diego, State of California, particularly described on Exhibit II A II . 2. A public hearing shall be held at the City Council Chambers at 1200 Elm Avenue, Carlsbad, California, at 6:OO P.M. on March 5, 1985, for the purpose of hearing all persons interested in or objecting to said proposed vacation.
