P&R CITY AlN.~ CITY MGR.& RECOMMENDED ACTION: City Council approve Resolution No. 7?/0 amending the agreement between the City and School District for use of the Carlsbad Municipal Swimming Pool. ITEM EXPLANATION: The Carlsbad Unified School District has requested additional use of the swimming pool for instructional and competitive programs. The following changes have been made to the agreement: 1. 2. 3. 4. 5. 6. 7. At The District and City agree to joint use between 3:OO and 5:OO p.m. and 7:15 and 8 a.m. from September to June and from 7 to 9 a.m. from 8/19/85 to 9/6/85 and 8/8/86 to 9/5/86 subject to reconsideration after their program has begun, when the number of students can be measured and the safety of joint use can be determined. The City agrees to expand exclusive^ District use the following times: 2:OO p.m. - 3:OO p.m. September - June 7:30 p.m. - 9:30 p.m. 8/19/85 to 9/6/86 The City agrees to allow the District exclusive use during scrimmages and competition meets subject to advanced notice for scheduling purposes. The City agrees to allow the District to conduct the instructional program free of charge from: 11:15 a.m. - Noon 2:OO p.m. - 3:OO p.m. During joint use times the City will provide lifeguard service for both District and City. The District agrees to the following rental rates: Exclusive Use - $14/hour Nonexclusive Use - $7/hour Effective 1986-87 the rental rates will be subject to ren gotiation. the regular School Board meeting on January 7, 1985, the Board of Trustees approved the ammendments. Parks and Recreation Commission At their meeting on November 19, 1984 the Parks and Recreation Commission discussed this issue and recommended the District be granted the additional . use of the pool. FISCAL IMPACT: The City will charge the District the following rates: Exclusive Use - $14/hour Nonexclusive Use - $7/hour It is estimated the City will receive rental rates from the District as follows: 1985 $3,900 1986 $3,900 $7,800 EXHIBITS : 1. That the agreement attached hereto and marked Exhibit "A" and made a part hereof is hereby approved. AYES: Council Members Casler, Lewis, Kulchin, Chick and Pettine NOES: None ABSTAIN: None ABSENT: None ATTEST : 3 AMENDMENT TO THE AGREEMENT FOR USE OF COMMUNITY SWIMMING POOL AND THE CULTURAL ARTS CENTER BETWEEN THE CITf OF CARLSBAD AND THE CARLSBAD UNIFIED SCHOOL DISTRICT THIS -BENT is made this day of 1985, between the CITY OF CARSLBAD, a municipal corporation of the State of California, hereinafter referred to as CITY, and the CARLSBAD UNIFIED SCHOOL DISTRICT OF SAN DIEGO COUNTY, CALIFONRIA, hereinafter referred to as DISTRICT. WITNESSETH: WHEREAS, the City and District entered into an agreement dated July 13, 1983, for use of the Commur.ity Swimming Pool and the Cultural Arts Center; and WHEREAS, the City and District wish to amend their agreement for use of the Community Swiming Pool. NOW, THEREFORE, BE IT RESOLVED, the parties agree to the amendments as follows: B. Use of the Pool This section shall now read: "City shall have use of the pool for any and all purposes and at all times except as otherwise expressly provided in Exhibit "A". The concept of joint-use is subject to reconsideration after the District program has begun, when the number of students can be measured and the safety of joint-use can be determined. The City also agrees to allow the District exclusive use during scrimmages and competitive meets subject to advance notice for scheduling purposes. Use of pool by District during other than the times provided in thig section, may be obtained by submitting a fklity use application for the pod which may be approved by the City if the City determines the pool is available and the use is consistent with City programs. $14.00 per hour for exclusive use and $7.00 per City shall charge the District hour for nonexclusive use. However, effective 1986-87 the rental rates will be subject to renogo- t iat ion . District has priority use of the pool during the times provided in this section. However, the City may have the option to schedule City activities during such hours that District is not utilizing the pool. Pool maintenance will require the pool to be closed from time to time. The pool schedule shall include provisions for such closures. City shall make reasonable efforts to schedule maintenance activities during periods when pool is not being used by the District. Conditiom of District Use The following-sentence shall be added to this section: "Durisg joint use times, the City will provide lifeguard service for both District and City." This agreement will allow the Carlsbad High School to begin the aquatic program that will include swimming and water polo. in February, 1985, as per our meetings. The program is scheduled to begin One change in the schedule was made concerning the 7:15-8:00 AM hours. facility on an exclusive basis during this time, therefore, the District would like the rate reduced to the $7.00 per hour rate.
