RECOMMENDED ACTION:
Council direct which of two alternatives is to be constructed for the
James Drive Assessment District:
A. Cul-de-sac as shown on Exhibit 1.
B. Through street as shown on Exhibit 2.
2. If Alternative B is directed, adopt Resolution No.declaring
its intention to consider alternate improvements in a special
assessment district.

expressed concern about the cost of the district and some Councilmembers
expressed an interest in seeing James Drive be a thru street to Oak

A second alternative (B) showing James Drive extending to Oak Avenue was
prepared and new assessments calculated. This generally reduces most
assessments slightly because the incidental expenses are spread over more
properties. One property owner (Assessment Numbers 11 and 12) has a high
increase under Alternative B. Under this alternative, the property is
assessed for all street improvements. Also, it has been assumed that the
property must be purchased and the assessment spread includes land and
acquisition costs. The total assessment on these two parcels is $243,611
of which approximately $130,000 is acquisition costs which could be
eliminated if the owner dedicated the right-of-way.
Reaction of several property owners to the thru street alternative is
favorable because their assessments are slightly reduced. The owner of the
two parcels with the significant assessment increase has not been
contacted.

Council has previously appropriated $78,000 for the formation of the
district. Approximately $48,000 of that has already been spent.
For most property owners, there is no significant difference in the
assessments of the two alternatives. For assessment numbers 11 and 12,
Alternative A provides only sewer and water across the property (the storm
drain would be paid for by the City). Alternative B includes street
construction and property acquisition at a very substantial increase to the
owner.
The storm drain to be built in James Drive is part of the Master Drainage
Plan and is to be paid for by drainage area fees. Staff is proposing that
the City pay a cash contribution for the construction of this drain
(estimated cost of $39,140) and be reimbursed as developers pay their
required drainage area fee. As of July 1, 1984, $20,411 in fees were
available in Drainage Area No. 4. The balance would have to be loaned to
this area from another source.
Several properties have a side yard abutting James Drive, but since they do
not get access and therefore receive no benefit, they are not being
assessed. Staff recommends that the City bear the costs of the sidewalk,
curb and gutter, and 8-feet of paving along these frontages as a more
equitable solution than spreading this cost to the other owners. Under
Alternative A, two properties are involved at a cost to the City of $9,225.
Under Alternative B, three properties are involved at a City cost of
$15,266.
If the district is successful, City expenditures of $78,000 to form the
district will be reimbursed by the sale of bonds and the City will make a
cash contribution of either $48,365 or $54,266.
If the district fails at the Debt Limit Hearing, City expenditures to date
of about $48,000 will not be reimbursed.

2 CARLSBAD, CALIFORNIA, DECLARING ITS INTENTION
TO CONSIDER ALTERNATE IMPROVEMENTS IN A SPECIAL
3 ASSESSMENT DISTRICT. ___
4 WHEREAS, the City Council of the City of Carlsbad, California, has
5 previously initiated proceedings and set a public hearing pursuant to the
6 terms and provisions of the "Special Assessment Investigation, Limitation
7
and Majority Protest Act of 1931", being Division 4 of the Streets and
8
Highways Code of the State of California, for an assessment district
9
designated as

ASSESSMENT DISTRICT NO. 83-2
11 (3AMES DRIVE)
12 (hereinafter referred to as the "Assessment District"); and,
13 WHEREAS, at this time the public hearing on said Assessment District
14 has been opened and continued, and this legislative body is now desirous to
15 consider a proposed alternate to the proposed works of improvement for said
16 Assessment District.
17 NOW, THEREFORE, IT IS HEREBY RESOLVED AS FOLLOWS:
18 SECTION 1. That the above recitals are all true and correct.
19 SECTION 2. That the public interest and convenience requires, and it
20 is the intention of this City Council, to consider an alternate proposal
21 for the works of improvement in the Assessment District, as said alternate
22 proposal for the works of improvement is set forth in the attached,
23 referenced and incorporated Exhibit "A".
24 SECTION 3. NOTICE IS HEREBY GIVEN THAT THE ORIGINAL HEARING ON THIS
25 ASSESSMENT DISTRICT HAS BEEN CONTINUED TO TUESDAY, THE 19TH DAY OF MARCH,
26 1985, AT THE HOUR OF 6:00 P.M., IN THE REGULAR MEETING PLACE OF THE CITY
27 COUNCIL, BEING THE COUNCIL CHAMBERS, CITY HALL, AND AT SAID TIME THE CITY
28 COUNCIL WILL CONSIDER ANY PROTESTS OR OBJECTIONS TO THE ORIGINAL PROPOSED
WORKS .OF IMPROVEMENT AS WELL AS ANY PROPOSED CHANGES AND MODIFICATIONS BY
2 REASON OF THE PROPOSED ALTERNATE WORKS OF IMPROVEMENT, AS SET FORTH IN THIS
3 RESOLUTION. ANY OBJECTIONS SHOULD BE IN WRITING AND FILED WITH THE CITY

6 SECTION 4. That the City Clerk is hereby directed to immediately mail

copies of this Resolution, upon its adoption, to all property owners owning
8 property within the boundaries of the Assessment District. Said mailing
9 shall be to the owner or owners of said property as said names and
10 addresses appear on the last equalized assessment roll or as known to the
11 City Clerk.

PROPOSED ALTERNATE WORKS OF IMPROVEMENT
I. A description of the proposed alternate works of improvement is as
follows:
Construction of certain street improvements in James Drive
between Oak Avenue and Basswood Avenue, including but not limited
to, grading, paving, curb and gutter, drainage facilities, water
and sewer improvements, public utility facilities, and
acquisition of rights-of-way, where necessary, together with
appurtenances and appurtenant work, to serve the parcels within
the boundaries of Assessment District No. 83-2 (Dames
Drive).
II. The proposed alternate works of improvement will cause the following
changes and modifications in the assessments:
