RECOMMENDED ACTION:
STREET VACATION OF A
PORTION OF
CARLSBAD BOULEVARD
TITLE
Adopt Resolution No. 792.s vacating a portion of Carlsbad Boulevard
between Sequoia Avenue and Chinquapin Avenue.
ITEM EXPLANATION:
The City Council on February 13, 1985, adopted Resolution No. 7907, a
Resolution of Intention to vacate a portion of Carlsbad Boulevard between
Sequoia Avenue and Chinquapin Avenue. The City Council set March 5, 1985,
at the hour of 6:OO P.M. as the time and the City Council Chambers, 1200
Elm Avenue, as the place for a public hearing for all persons interested in
or objecting to said proposed vacation.
The request to vacate a portion of the public street was made by Gemini
Development Corporation, owners of the property. They plan to construct an
eight-unit condominium development known as The Shores.
Staff has reviewed the request and concluded that the excess street right-
of-way is not needed for any foreseeable street widening, The improvements
proposed as part of the project will align the curb and gutter to the south
so as to meet the roadway improvements of the Aqua Hedionda Bridge replace-
ment. To the the north, in the block between Sequoia and Tamarack, the
street is eleven (11) feet wider toaccommodate a free right turn lane onto
T ama r ac k .
The utility companies have been notified of the vacation and the street
vacation Resolution specifies that the area being vacated will be retained
as a utility and slope easement. It cannot be built upon. The Resolution
also specifies that the street vacation shall not be recorded by the City
Clerk until street improvements in the form of curb, gutter, sidewalk, and
tie-in pavement have been constructed, or funds therefor deposited with or
guaranteed to the City.
FISCAL IMPACT
Approval of this vacation will result in approximately 2
land to be returned to the tax rolls. 100 square feet of

A RESOLUTION OF THE CITY COUNCIL Of THE CITY OF CARLSBAD,
CALIFORNIA, VACATING A PORTION OF CARLSBAD BOULEVARO
BETWEEN SEQUOIA,AVENUE AND CHINQUAPIN AVENUE.
BE IT RESOLVED by the City Council of the City of Carlsbad,
California, as follows:
1. That all publication and posting notices regarding the proposed
vacation of a portion of Carlsbad Boulevard between Sequoia Avenue and
Chinquapin Avenue, pursuant to Resolution of Intention No. 7907, have been
given as required by law.
2. That the City Council did hear the evidence offered by all
persons interested in said proposed vacation and does find from all the
evidence submitted that a portion of Carlsbad Boulevard, in the City of
Carlsbad, County of San Diego, State of California, particularly described on
Exhibit "A", attached hereto and by this reference incorporated herein, is
unnecessary for present or prospective street purposes and does hereby make
this order vacating said portion of Carlsbad Boulevard.
3. The entire area to be vacated will remain as a utility and slope
easement.
4. The City Clerk is instructed to record this Resolution of Vaca-
tion after the street improvements have been constructed or funds therefor
deposited with or guaranteed to the City.
PASSED, APPROVED AND ADOPTED at a regular meeting of the Carlsbad
City Council held on the 5th day of bhr& , 1985 by the following
vote, to wit:
