ITG. 3/5/85 CA llU& PROPOSED ORDINANCE REGULATING TV DISH ANTENNAS DEPT-HD. - CINAlTY li'Fd CITY MOR.-- ?ECOMMENDED ACTION: If the City Council concurs that regulations are needed in Carlsbad for TV dish antennas your action is to direct the City Attorney to prepare a proposed ordinance and set it to public hearing before the Planning Commission. ITEM EXPLANATION The Mayor has asked our office to prepare this agenda bill so the Council could consider whether or not there is a need in Carlsbad for an ordinance regulating TV dish antennas. The Mayor's concern was prompted by some recent newspaper articles indicating that the antennas may "fall in the cracks" of existing zoning ordinances and that they could be constructed in locations that would obstruct views, intrude in front and side yard setbacks, and cause neighborhood problems. The Carlsbad Municipal Code currently regulates antennas like those used by ham radio operators requiring a conditional use permit before they can be installed. The Land Use Planning Department reports they have had several inquiries about TV dish antennas. The department has taken the position that the CUP requirement applies. However, our ordinances are less than clear on that point. It appears, W dish antennas may not be regulated by our ordinances. The Mayor has suggested that the City Council determine whether or not this type of antenna should be allowed in Carlsbad, and, if so under what circumstances. If the City Council determines that regulation is necessary, your action is to direct us to prepare the necessary ordinance and set it to hearing before the Planning Commission and City Council.
