That City Council approve an above ground encroachment permit for the construction of a retaining wall within City right-of-way.
ITEM EXPLANATION:
The Fitzpatricks of 4246 Highland have requested an above ground encroachment
permit to construct a retaininq wall varying in height from two-to-four feet within City right-of-way. The retaining wall will be outside of the existing traveled way and will allow the Fitzpatricks to place some fill in their front
yard area making their yard approximately the same elevation as adjoining properties. As part of their development plan, they propose to construct some on-site parking in lieu of the on-street parking that would be lost as a result
of the retaining wall.
Staff would normally recommend against such a practice in that it affects on-street parking but, in this instance, we recommend approval. of onsite parking will offset the loss of on-street parking and will make the
Fitzpatricks' property more consistent with the rural atmosphere on this portion of Highland.
The provision
The Fitzpatricks will be required to provide liability insurance to protect the
City against any claims that may result from this above ground encroachment.

We are applying for an above-grade encroachment permit
for the purpose of constructing a two-to-three-foot high
masonry retaining wall across the front of our porperty
at 4246 Highland Drive.
At some time in the past previous owners had the front
yard graded all the way down to street leve. This has
resulted in several conditions that are not pleasing, neither aesthetically nor practically. From the intersection of Hillside and Highland, heading south along the east side of Highland for a distance of approximately 300 yards to
our property and continuing southward, the grade levels of
the other front yards are all higher than ours by several
feet. Along this entire distance are stone or masonry
retaining walls ranging in height from 2% to 3 feet and up
to 4 feet, generally right at the edge of the street pave-
ment. This permits a more level front yard than we have.
The condition of ours invites parking on the street and on
up into our yard.
In effect, we would like to see the front of our property
be put back into its original condition and in conformity
with the others along that stretch of Highland.
It is unattractive and hard to maintain in its present
condition, particularly with its open invitation to on-street
parking.
You may rest assured that, in addition to making it consistent
with the rest of that stretch of Highland, we propose to
make it visually attractive and structurally sound.
We would appreciate the opportunity to present pictorial
evidence as to the existing conditon, as well as drawings
of what we propose to do if the permit is granted.
