Specific Plan 185 is a combination district (TS, 0, Os) on 96.6 acr on the south side of Highway 78, approximately one-half mile east Q
Real- The Applicant is requesting that the specific plan be extend
The Applicant agreed to pay Public Facilities Fees with the origina application. Planning and Engineering staffs have reviewed this pr recommend exteding Specific Plan 185 to coincide with expiration o Tentative Map (CT 83-12) for this project.

Dear Mr. Beckman:
This letter will confirm our conversation today wherein I explained my representation of the Community Resources
Corporation and an interest in extending the Tentative Map known as Buena Vista CT 83-12 and Buena Vista Plaza
Specific Plan. As you are aware, the Specific Plan is due to expire on March 15, 1985 and CT 83-12 expires on
July 27, 1985.
It is our understanding these requests for extensions shou be coordinated and presented to the City Council simultane
Therefore, it is imperative that both matters be presented
to the City Council no later than the City Council meeting
of March 13, 1985.
Realizing the Planning Department is laboring under an
increased burden in reviewing the General Plan, you noted
that these extensions may be administratively proved priox
to expiration, although submitted to the City Council subsequent thereto.
Due to the importance of this project to my clients and ir
the exercise of an abundance of caution, we would urge yoc
in coordination with the Planning Staff, to make every
effort to present these requests for extension to the Citl
Council prior to the March 15, 1985 expiration date.

RESOLUTION NO. 7941
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD,
CALIFORNIA, APPROVING AN EXTENSION OF TIME FOR SPECIFIC
PLAN 185, SUBJECT TO CERTAIN CONDITIONS
WHEREAS, the City Council of the City of Carlsbad on the 15t
March, 1983, adopted Ordinance Nos. 9672 and 9673 approvir
conditions, Specific Plan 185; and
WHEREAS, Specific Plan 185 is now inconsistent with the Gene
of the City of Carlsbad because the City Council has found tha
facilities are inadequate; and
WHEREAS, said Specific Plan will expire on March 15, 1985,
Applicant has requested an extension of time which cannot be
unless the specific plan can be brought into conformity with tht
Plan; and
WHEREAS, the addition of certain conditions of approva:
Specific Plan will allow it to be found to be in conformity
General Plan and the Developer- has requested the imposition
conditions and agreed to comply with them; and
WHEREAS, the approval of an extension of Specific Plan 185 E l8

i i such conditions, in lieu of denial of the plan, will allow the F
go forward avoiding the unnecessary delay to the City and to the
involved with denial and the new application which would then be
subject to the same set of conditions; and
WHEREAS, both the Developer and the City wish to extend th
plan subject to the additional condition;
NOW, THEREFORE, BE IT RESOLVED by the City Council of tt
Carlsbad, California, as follows:
A. That the above recitations are true and correct.
E. That Specific Plan 185 is hereby extended from Marct

to July 27, 1985, subject to the execution and fulfillment of
conditions of Ordinance Nos. 9672 and 9673 and the following adc
condition:
(1) This approval is expressly conditioned on the payment
Applicant of a Public Facilities Fee as required by City
Policy No. 17, dated February 24, 1982, and effective I
1982, on file with the City Clerk and incorporated he
reference, and according to the agreement executed
Applicant for payment of said fee. If said fee is not
promised, this application will not be consistent v
General Plan and the project cannot proceed and this
shall be void.
