RECOMMENDED ACTION:
Adopt Resolution No. 7?.J.S: opposing SB 191 and SCA 8.
ITEM EXPLANATION:
SB 191 and SCA 8 would allow cities to annex land located
in another county. The City of Oceanside opposes this
legislation and is asking other cities to also oppose the
legislation.
Mayor Casler asked that this item be placed on the agenda
for Council action.
FISCAL. IMPACT:
No direct impact on Carlsbad.

RESOLUTION NO. 7935
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF CARLSBAD, CALIFORNIA OPPOSING
SB 191 AND SCA 8
WHEREAS existing law does not allow annexation of land to
6 cities across county boundaries, and
7 WHEREAS allowing such annexations would cause unnecessary
8 confusion in providing services;
9 NOW, THEREFORE, BE IT RESOLVED by the City Council of
10 the City of Carlsbad as follows:
11 1. That the Carlsbad City Council is opposed to
12 SB 191 and ~CA 8 that would allow annexation across county
13 boundaries.
14 PASSED, APPROVED AND ADOPTED at a regular meeting of the
15 City Council of the City of Carlsbad held the 19th day of
16 March , 1985, by the following vote, to wit:

I am writing to urge the San Diego Association of Governments
to join the County of San Diego and the City of Oceanside in
opposing SB 191 and SCA 8. SB 191 would authorize cities to
annex contiguous land that is located in another county, and
it would provide that the LAFCO having jurisdiction over the
annexation is the LAFGO of the county where the majority of
the property propsed to be annexed is located. SCA 8 is a
constitutional amendment which would allow a'city to be divided
into more than one municipal or justice court district. This
change is needed to allow cross-county annexations.
The·City of OceansidP opposes this legislation for several
reasons. We believe that simplicity should be a key objective
in providing county and law enforcement s~~vices, and establishing
political jurisdiction. This legislati0n would create a dual-
standard for providing services to the residents of a single
city, and would compound administrati,e problems in collecting
and distributing taxes, conducting trials, and providing urban
services.
SANDAG's regional review functions and membership rules could
be seriously complicated if an Orange, R~verside, or Imperial
County ctty were to.annex territory in San Diego County. For
example, would a city with d small amount of territory in San
Diego County be given voting status on SANDAG? Could a single
agency be the member of more than one COG?

The City of Oceanside believes that~ better solution would be
to change county boundaries if, in 'fact, those boundaries do
not currently provide for logical city boundaries. We believe
that this is an issue of regional significance, and I would
urge all other jurisdictions in San Diego County to join in
opposition to SB 191 ana SCA 8.
