HD,.+--/JCc::::,-- CITY ATTY-+1--'==' CITY MGR.~ ,.,T'l,,l DEPT._"_ ... _11 __ _ RECOMMENDED ACTION: Adopt Resolution No. 19'(7, authorizing the destruction of certain files. ITEM EXPLANATION: This agenda bill is part of a continuing Record Management Program for City Departments. Adoption of the Resolution will complete the destruction of obsolete and unnecessary files in the Finance Department. Section 34090 of the Government Code provides authority for destruction of documents which are more than two years old and are no longer required. Thi~-q~ction also requires the consent of the City Attorney and the author- ization of the City Council prior to the destruction of any documents. Section 34090 does not authorize the desctruction of the following: l. Records which affect title to real property. 2. Minutes, Ordinances, or Resolutions of the City Council or of any City Board or Commission. The documents listed as Exhibit "A" to Resolution No. 72 4'1 , have been reviewed in accordance with the provisions of the Government Code, and meet those requirements and the City Attorney has consented to Lheir destruction. FISCAL IMPACT: None EXHIBITS: 1. Exhibit "A", list of records desired to be destroyed. 2. Resolution No. 791/2, authorizing the destruction of documents listed in Exhibit "A". EXHIBIT 11 A" The Finance Department, as part of their Record Management Program requests consent to destroy the following records: City Warrants -copies Housing 'Warrants -copies Bank Statements Water Billing Stubs Business Licenses Waterworks Revenue Bonds & Coupons 1958 Series Closed. 1977 1976-78 1976-79 1975-6/79 1977-81 1976-79 I have reviewed the above list and certify that the necessary and meet all the criteria set forth in Government Code. WHEREAS, maintaining all obsolete files, correspondence and papers is uneconomical; and WHEREAS, Section 34090 of the Government Code provides authority for this destruction of certain records; and WHEREAS, the documents listed on Exhibit 11 A11 , attached hereto and made 9 a part hereof, have b~en reviewed by the Finance Director; and 10 WHEREAS, the Finance Director recommends that all documents listed on 11 Exhibit "A" are no longer required, and meet the requirements of Government 12 Code Section 34090 for destruction; and 13, WHE~AS, the City Attorney has consented to the destruction of these 14 documents listed on Exhibit "A"; 15 NOW, THEREFORE, BE iT RESOLVED by the City Council of the City of 16 Carlsbad, as follows: 17· 18 L That the above recitations are true and correct. 2.
