BLDG MTG.PC.E RECOMMENDED ACTION: TITLE: REMOVAL OF OFF-SITE SUBDIVISIONS CITY ATTY SIGNS ON COUNTY PROPERTY CITY MGR.~~ Staff is recommending that the City Council authorize the Mayor to send a letter to the County Board of Supervisors asking for their assistance in the removal of off-site subdivision signs On County land within Carlsbad's sphere of influence. ITEM EXPLANATION: Early last year, the City contacted a member of the Board of Supervisors regarding off-site subdivisions' signs located on County islands in the Carlsbad's sphere of influence. The Supervisor indicated a willingness to help remove the signs. Over a year has passed since the County agreed to assist Carlsbad in resolving the sign problem. Discussions with County Planning Officials have not produced any positive movement in removing the signs , In the meantime, the City has adopted a "Temporary Community Directional Signs" program. This ordinance will solve the problem of off-site subdivision signs located in the City's boundries, but could not affect signs located in the County, Staff is recommending that the City increase its efforts in working with the County to resolve this issue. Many sign building representatives ---- -- .. were present, During the discussion it was determined that many signs on County property within the City boundaries do not have valid permits. A few years ago at a joint meeting of our two govern- mental agencies, the County agreed that in land use matters the County would abide by the Carlsbad General Plan for any development within our boundaries. We would request now that this agreement be extended to include a ban on off-site real estate signs. We would greatly appreciate your help on this issue. . Sincerely, MARY CASL Flay or MC : gb EXHIBIT 2 3 -XARCH 1, 1985 TO : CITY MANAGER FRO14 : Director of Building and Planning OFF-SITE REAL ESTATE SIGNS ON CITY/COUNTY BOUNDARIES On January 19, 1984, Carlsbad's Mayor Mary Casler wrote a letter to County Supervisor Paul Eckert requesting a ban on off-site real estate signs on County property within Carlsbad's sphere of influence. (See Attachment 1) Paul Eckert replied on February 23, 1984, and stated that the County planned to raise the priority of sign enforcement of County property within Carlsbad's sphere of influence. He also wrote that the County's Sign Ordinance was going to be amended in an effort to accommodate Carlsbad's needs. (See Attachment 2) The County has initiated strict enforcement of their sign regulations in the North County. Permits are now required for all real estate directional signs and their size, number, and location now conform with County sign regulations. They have amended their pernit section to require a sign plan and a notification of an administrative sign pernit to adjacent property owners. The problem still is that the County's ordinance is far less restrictive than Carlsbad's. Therefore, we continue to receive complaints about development signs within our sphere of influence, more specifically, the south side of La Costa Avenue between El Canino Real and 1-5, and the County islands along El Camino Real. On January 8, 1985, a meeting took place with the County's Zoning Enforcement Investigator Edward Colby and the City's Enforcement Section regarding off-site signs on County land within Carlsbad's sphere of influence. The discussion revealed that the County is hesitant to release enforcement to another agency. Mr. Colby stated that the steps necessary to initiate an amendment to the existing ordinance would be: 1. A letter from Carlsbad to the Board of Supervisors requesting a change in enforcement procedures or an amendment to the existing off-site sign ordinance. EXHIBIT 3 . .. MARCH 1, 1985 CITY MANAGER Page 2 2. The County's Planning Denartment would have to draft an ordinance change. 3. The Board of Supervisors would have to pass the ordinance change. The County is hesitant to relinquish enforcement authority to the City of Carlsbad. The County's Sign Ordinance does not address the City of Carlsbad's problems regarding off-site signs on County land within the sphere of Carlsbad's influence. My recommendations are: 1. Request the County amend their off-site sign regulations to allow us to enforce Carlsbad's Sign Ordinance on County islands within Carlsbad's sphere of influence. 2. Request the County to enforce Carlsbad's Sign Ordinance on County islands within Carlsbad's sphere of influence. 3. I wrote a letter to Mr. Eckert in January of last year requesting his assistance. Mr. Eckert's reply indicated that help would be forthcoming. This has not happened. Discussions with County Planning Officials revealed that staff members could take no action on the off-site real estate sign problem until the County Board of Supervisors amended the County's Off-Premise Sign Regulations. Therefore, acting on the behalf of the Carlsbad City Council, I formally request that you amend the County's Off-Premise Sign Regulations to allow the City of Carlsbad to enforce its sign ordinance on County islands within Carlsbad's sphere of influence.
