RECOMMENDED ACTION:
It is recommended that the City Council authorize the concept of
the sale of surplus street right-of-way on El Camino Real at Elm
Avenue
ITEM EXPLANATION:
HCH & Associates is developing the property at the northwest and
southwest corners of the subject intersection and is requesting
the City to sell the surplus right-of-way. The City of Carlsbad
is the owner in fee of the property.
The surplus right-of-way is in two parts [(A) equals 0.876
and (B) equals 0.598 acres] totaling 1.474 acres.

The developer is required to extend Elm Avenue from the west to
El Camino Real. The developer will make provision to handle the
drainage which presently flows through the surplus land area.
The City Council is being requested to approve only the concept
of selling the surplus street area. That will permit the
developer to prepare plans for approval by the Planning
Commission. If the project is approved, then the City Council
will have two more opportunities to approve the actual
disposition of the property. The first will deal with the street
vacation, the second with the sale, as negotiated.
ENVIRONMENTAL IMPACT
The Land Use Planning manager has determined that release of the
property for development is subject to environmental review. The
negative declaration previously issued does not cover the subject
surplus property.
FISCAL IMPACT
If the surplus property is ultimately sold, staff recommends that
it be based upon an impartial appraisal. Revenue to the City
cannot be ascertained at this time.
