ITEM EXPLANATION
The Mayor has asked our office to prepare this agenda bill to present a series of actions to the City Council for your consideration which would adopt a proposed Arts Element as a of the General Plan for the City of Carlsbad; create an Arts
Commission with substantial authority to implement that elemc
approve a proposed job description for the staff coordinator the Arts Commission and direct the City Manager to include a proposed budget for the City's arts program as a part of the 86 fiscal year budget.
The Planning Commission, at their meeting of March 27, 1985, adopted Resolution No. 2427 recommending approval of an amenc to the General Plan to adopt an Arts Element. The Planning Commission Resolution and staff report on the matter are att; as Exhibit 1. If the City Council concurs your action is to Resolution No. FOla , which would approve GPA/A 85-1

The Element provides for the creation of an advisory Arts Commission. In that regard attached is Ordinance No. 1279 which we have prepared incorporating the provisions for the Commission as recommended by the ad hoc committee and the Ma The Commission is proposed to have substantial powers to do everything necessary to implement the General Plan element including the administration of a Carlsbad Arts Commission f The ordinance also provides for a second fund for City budge amounts for the arts and imposes a requirement that City departments include an additional amount of one percent of t total construction costs of projects for works of art.

"A", dated March 27, 1985, has been filed with the Planning
Commission; and

It is recommended tha the Planning Commission approve the Negative Declaration issued by the Land Use Planning Manager and
ADOPT Resolution No. 2427 recommending APPROVAL of GPA/A 85-1.
I1 . BACKGROUND
The Ad Hoc Committee for the Arts has met regularly since Januarl to formulate guidelines for the City regarding a permanent City
Arts Commission and an Arts Element to the General plan, The concept of an Arts Element was addresed by Council on March 12th,
At that meeting the Council accepted the concept and directed staff to schedule a public hearing at the next available Planninc Commission meeting.

The Ad Hoc Committee and staff feel that an Arts Element is
desirable as it would promote a higher emphasis on the arts and help facilitate development of the various art forms in Carlsbad.

The major policies outlined by the proposed Element are designed to encourage private contributions to the arts, promote works of art in public places, facilitate interagency cooperation to display works of art in Carlsbad, and to generate various programs that would help to develop skills in all levels of
creative expression.
Staff feels that the Arts Element will be of great benefit to
the Community and recommends that the Planning Commission adopt Resolution as proposed by staff,
IV. ENVIRONMENTAL REVIEW
The Land use Planning Manager has determined that there will be
no significant environmental impacts resulting from this project and has issued a Negative Declaration on March 14, 1985.

ARTS ELEMENT
The Arts Element of the General Plan recognizes that the
arts are a part of the cultural and aesthetic environment
and that the City of Carlsbad shall create a climate which
encourages artistic development.
GOAL :
To facilitate opportunities for the active participation of all citizens in developing their creative skills and appreciation for the arts.
Objective No. 1: To cooperate with and coordinate

2.18.010 Created. A Carlsbad Arts Commission for
City is created.
2.18.020 Purpose. The purpose of the Carlsbad Ar Commission is to advise the city Council on the implementat of the Arts Element of the Carlsbad General Plan.
2.18.030 Membership - terms - vacancies. The Carlsbad Arts Commission shall consist of seven members
appointed by the Mayor with the approval of the City Counci

- 2.18.040 Compensation. The Carlsbad Arts Commissio
shall act without compensation.
2.18.050 Chairman. The members of the Carlsbad Art Commission shall elect their own chairman who shall preside i
all meetings. The chairman shall hold office for a term of t
year. Thereafter a new chairman shall be elected at each succeeding year. One chairman may serve for more than one successive term.
2.18.060 Meetings. The Carlsbad Arts Commission shall establish a regular time and place of meetings and shall hold at least one meeting each month. The majority of appointed members shall constitute a quorum for the purpose transacting the business of the commission.
2.18.070 Coordinator. The City Manager shall appo an employee of the City to act as coordinator and staff to t commission.
2.18.080 Duties. The Carlsbad Arts Commission shz have the power, and it shall be the duty of the commission, make recommendations to the City Council and advise the Cour on the implementation of the Arts Element of the General Pli
2.18.090 Rules. The commission may adopt its own 1 rules and regulations.

2.18.110 Funds - disposition of monies. The City Council shall establish a fund to be known as the Carlsbad A. Commission Fund. All monies in the fund shall be used for the promotion, supervision and operation of the arts and if not used during current year shall accumulate in the Fund. Any expenditures from the fund shall be subject to prior approval by the City
Council.
2.18.120 Budget. The Carlsbad Arts Commission may submit a budget request to the City Council on or before the
15th day of April of each year. The budget shall include an annual recommendation to the City Council for the expenditurc funds in the Carlsbad Arts Commission Fund.
2.18.130 Appropriations for arts. a) In addition to any budget fund all city departme heads shall include in all estimates of necessary expenditure and all requests for authorizations or appropriations for construction projects, an amount for works of art equal to at least one percent of the total cost of any such construction
project as estimated in the City's capital improvement progri for the year in which such estimate or request is made. If t are legal restrictions on the source of funding with respect

any particular project which precludes art as an object of expenditure of funds, the amount of funds so restricted shall excluded from the total project cost in making the required estimate. b) The City Council may make appropriations for wor of art in connection with construction projects as provided i this chapter and may also provide for the appropriation of fu

2.19.150 Powers delegated to commission to be advis Nothing in this chapter shall be construed as restricting any
the powers of the City Council, or as a delegation of the Carlsbad Arts Commission of any of the authority or discretic powers vested and imposed by law in the City Council. The Cj Council declares that the public interest requires the appointment of a Carlsbad Arts Commission to act in a purely advisory capacity to the City Council for the purposes enumerated. Any power herein delegated to the commission to adopt rules and regulations shall not be construed as a
delegation of legislative authority but purely a delegation ( administrative authority. 'I

JOB DESCRIPTION, COORDINATOR TO ARTS COMMISSION
DEFINITION
Under general direction, to administer a program to promote
the visual and performing arts in the City; to plan, organize
and coordinate a city-wide arts program; and to do related work as assigned.
DISTINGUISHING CHARACTERISTICS
Incumbent serves as staff to the City's Arts Commission
and is administratively attached to the City Library.
EXAMPLES OF DUTIES
Provide technical and professional staff assistance to the
Arts Commission.
Direct and participate in the development and implementation of the City's goals, objectives and priorities for the arts.
Plan and implement informational programs to stimulate and maintain community interest in and support of the arts.
Develop and submit applications for grants from government
agencies and private foundations.
Prepare and administer the budget of the Arts Commission.
Prepare reports for the City Manager, City Council, Arts
Commission and others.
Represent the City in the community and at professional meetings as required.
QUALIFICATIONS
