ITEM EXPLANATION
The City Council at your meeting of May 21, 1985 directed
our office to prepare a resolution approving CT 85-5.
conditions are as recommended by the Planning Commission in
Resolution No. 2431 with the following exceptions:
1. construct a fence separating the units from the identified riparian woodland area,
2. Planning Condition No. 11 has been revised to eliminate the provision for the formation of an open space maintenanc district. City Council ,policy #23 adopted August 2, 1983 provides for a maintenance district only in certain limited circumstances none of which are applicable to this project. The policy requires this type of open space to be maintaine
by the homeowner's association. A copy of policy number 23
is attached for your ready reference.

73 LOT TENTATIVE MAP CT 85-5 ON 23.6 ACRES OF
PROPERTY GENERALLY LOCATED ON THE EAST SIDE OF
MISSION ESTANCIA, SOUTHERLY OF THE PROPOSED LA COSTA AVENUE, MISSION ESTANCIA INTERSECTION.

WHEREAS, on April 24, 1985, the Carlsbad Planning
Commission adopted Resolution No. 2431 approving tentative
map CT 85-5; and
WHEREAS, the City Council on May 21, 1985 held a
hearing to consider the recommendations and heard all per$
interested in or opposed to tentative tract map CT 85-5; i

WHEREAS, a verified application for certain proper

Lot 140 of Record Map 9959 recorded in the Office
County Recorder of San Diego County, State of Cali on December 31, 1980, as File 80-440244,
has been filed with the City of Carlsbad, and referred to t

WHEREAS, said verified application constitutes a r
