ACCEPTANCE OF GRANT DEEDS FOR
CENTRAL BUSINESS STORM DRAIN
RECOMMENDED ACTION:
1. Adopt Resolution No. Ad{-- accepting grant deeds for a te
working easement and a permanent easement for storm drain purposes.
2. Adopt Resolution No, g&& quitclaiming a temporary working ei
and a storm drain easement.
ITEM EXPLANATION
The Central Business Storm Drain is being constructed primarily in an e
adjacent to the railroad and partially in State Street. At the point wl
goes from one to the other, it must cross private property. An easeml
obtained from the owner some time ago. However, this easement bi
against an existing two-story building which is likely to be endangl
trenching. The property owner has agreed to give us a new easement aw
the building in exchange for quitclaiming the old one.
Both the new and old locations involve a 12-foot wide permanent easement
22-foot wide temporary construction easement.
FISCAL IMPACT
The easements are being exchanged evenly at no cost to the City.
The new easements will make construction per the plans possible and (
reduce any possible liability caused by trenching adjacent to the builc

A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF CARLSBAD, CALIFORNIA, ACCEPTING
GRANT DEEDS FOR STORM DRAIN PURPOSES.

WHEREAS, ROBCO, a sole proprietorship, has submitted Grant Deeds t
a temporary working easement and permanent easement across Lot 14,
Lands, Map 1722, to the City of Carlsbad for storm drain purposes; ant
WHEREAS, the City Council of the City of Carlsbad has determined
in the public interest to accept said Deed;
NOW, THEREFORE, BE IT RESOLVED by the City Council of tht
Carlsbad, California, as follows:
1. That the above recitations are true and correct.
2. That the Grant Deed from ROBCO, a sole proprietorship, date(
1985, conveying easements to the City of Carlsbad which are on file
City Clerk and are incorporated herein by reference, are accepted.
3. That the City Clerk is authorized to cause the original Dei
recorded in the Office of the County Recorder of San Diego County,
California, with the appropriate Certificates of Acceptance attached.

QUITCLAIM OF TEMPORARY WORKING EASEMENT
AND PERMANENT EASEMENT FOR STORM DRAIN PURPOSES. -
WHEREAS, the City Council of the City of Carlsbad has determined
in the public interest to quitclaim said easements;
NOW, THEREFORE, BE IT RESOLVED by the City Council of tht
Carlsbad, California, as follows:
1. That the above recitations are true and correct.
2. That the Quitclaim Deeds conveying a temporary working easemc
