ITEM EXPLANATION
The applicant has requested approval of a three unit condominium permit and parcel map on property located at 3655 Garfield Street (location map attached). The three units would be contained in two 3-story buildings. During the public notice procedure, a number of concerns were identified and a petition circulated by surrounding residents. A public hearing was held by the City
Engineer. The residents felt that the project as originally proposed was too high (32 feet approximately), and too dense for the existing neighborhood. The project is proposed at 20.5 du's/acre and is located in the RH 20-30 du's/acre range. The residents were also concerned because the developer has already built a somewhat controversial project in the same area. That project is known as Nob Hill. Staff feels that the elevations on this project are better than on Nob Hill. The applicant has also indicated that he will use a more subtle color on this project.
Following the public hearing, the applicant worked with staff to try and mitigate the major concern, compatibility. There were no
other 3-story units in the area so the applicant agreed to reduce the height to approximately 25 feet. The density is at 20.5 du/ac which is at the low end of the range. Several of the neighbors felt that their concerns were not adequately mitigated and have appealed the project.
This project was not heard by the Planning Commission. Under the City's Ordinances, the City Council has given discretionary authority on parcel maps and condominium permits (less than 4 units) to the staff. Appeals go directly to the City Council.

FISCAL IMPACT
The increased need for city capital facilities resulting from this development will be offset by the payment of the public facilities fee. Any capital facilities related directly to this development will be constructed and paid for by the developer.
Increased operating expenses related to this development will be offset to some extent from increased tax or fee revenue generated by the development. No detailed economic impact analysis of this development has been conducted at this time so predictions of the portion of operating expenses covered by additional operating revenue created as a result of this project cannot be made.

A preliminary decision has been made, pursuant to Section 20.24.120 of the City
of Carlsbad Municipal Code, to approve the tentative map of the proposed minoc subdivision subject to the following conditions:

Final parcel map shall comply with the Planning Staff’s Condominium Report for CP-306, dated April 17, 1985.
This subdivision is approved upon the express condition that the final map
shall not be approved unless the City Council finds as of the time of such approval that sewer service is available to serve the subdivision.
This project is approved upon the express condition that Building Permits
will not be issued for development of the subject property unless the City Council or respective Sewer Agencies determine that sewer capacity is available at the time of application for such permits and will continue to
be available until time of occupancy. This note shall be placed on the
final map.
The Subdivider shall provide separate sewer, water, gas, and electric
services with meters to each of the units.
All required fire hydrants, water mains, and appurtenances shall be operational prior to combustible building materials being located on the
project site.
All required fees and deposits shall be paid prior to final parcel map
recordation. (S ee attached list.)
All lots within this project shall conform to current Zoning Ordinance (Title 21) with respect to size, setbacks, and land use.

Development of this project shall occur substantially the same as shown on
the tentative map with the exception of garage slab elevation 4.2 foot lower than existing grade, and roof peak 5’6” lower than original plan.
(See Exhibit l%‘l on file in Engineering Department.)
Prior to parcel map approval, a grading and drainage plan shall be
submitted to and aapproved by the City Engineer.
If a drainage pump is utilized to drain this project, it shall be subject
to approval of the City Engineer. Maintenance of all on-site drainage
systems shall be the responsibility of the homeowners, and clearly stated in C.C.&R’s.
The driveway into this subdivision shall be no steepr than 14% and shall
have a 4X transition from right-of-way back 20’.
Sewage design for this subdivision shaall be gravity flow type.
The developer shall make every effort to maximize landscaped areas, anQ minimize pavement, decks and retaining walls.
The driveway opening on Garfield Street shall be kept to a minimum (18’ is
accept able).
The tentative parcel map approval shall expire two (2) years from the date
of the letter containing the final decision for tentative map approval.
This approval is expressly conditioned on the payment by the Applicant of
the Public Facilities Fee as required by the City Council Policy No. 17,
dated February 23, 1982, and effective April 2, 1982, on file with the City
Clerk and incorporated herein by reference, and according to the agreement
executed by the Applicant for payment of said fee. If said fee is not paid as promised, this application will not be consistent with the General Plan
and the project cannot proceed and this approval shall be void.
The Applicant may request a review of the conditions in writing within ten
(10) days of the date of this approval.

The City has completed a review of the application for a two-unit condominium development located at 3655 Garfield Street.
It is the Land Use Planning Manager's determination that based on the attached conditions, the project is consistent with the City's condominium regulations (Chapter 21.45) and with all other applicable City ordinances and policies. Further, the project has been found to be categorically exempt from environmental review according to Section 15305.070(11)(4c) of the California Environmental Quality Act and a Notice of Exemption was filed on April 18, 1985.
This memo, including the listed findings and conditions, constitutes approval of CP-306
Findinas
1. The project is consistent with the City's General Plan Land Use Element, and with all other elements of the City's General Plan.
2. Adequate public facilities necessary to serve this project will be provided as required by the City Engineer in con- junction with the approval of the parcel map required for this project.
3. The project is consistent with the design criteria and development standards of Chapter 21.45 (Planned Development Ordinance) of the City's Zoning Code.
Conditions
1. Approval is granted for CP-306 as shown on Exhibits "A" - "F", dated March 1, 1985, and also Exhibit "l", dated April 20, 1985, on file in the Land Use Planning Office and incorporated herein by reference.
2. A copy of the final planned development site plan, incorpo- rating all conditions of approval, shall be submitted to and approved by the Land Use Planning Manager prior to final map approval of MS-682

3. All conditions of MS-682 are incorporated herein by reference and shall be complied with in their entirety.
4. Unless otherwise stated herein, this condominium project shall comply with all'applicable City ordinances and reguirements.
5. Development of this project shall occur substantially the same as shown on the tentative map with the exception of the garage slab elevation at 4.2 feet lower than the existing grade, and the roof peak at 5 ft. 6 in. lower than the original plan. (See Exhibit 'l", dated April 20, 1985.)

Dear Mayor and City Councilors:
I represent Robert L. Haman, the applicant in the above- referenced subdivision.
In October, 1984, Mr. Haman purchased the single-family residence at 3655 Garfield, located in an R-3 zone, with the intention of removing said residence and constructing a condo- minium project.
The appropriate applications were filed and, over a 6-month period, Mr. Haman and his architect, Robert F. Ardent, met with City Staff and with neighbors in the area. As a result of these meetings, Mr. Haman agreed to make several changes to satisfy those concerned, the most significant of which were as follows:
1. Reduce the project from 4 units to 3 units. The prop- erty consists of 6,352 square feet, thereby making the density with 3 units 20.58 units per acre.
2. Reduce the height of the building 5-l/2 feet by lower- ing it into the ground and changing the pitch of the roof.

3. Changing the driveway configuration to satisfy the concerns of Staff.
Following a public hearing at which these changes were made, Mr. Haman was led to believe by various newspaper articles that the citizens were satisfied with the project as modified.
Thereafter, Mr. Haman received a preliminary decision from the City Engineer dated April 18, 1985 (attached hereto as Exhibit "A") which informed him that a preliminary decision had been made to approve the tentative map subject to various condi- tions and further informed him that he had 10 days to request a review. Pursuant to Carlsbad City Code section 20.24.120(b), Mr. Haman waited 10 calendar days. Believing that the decision had thereby become final, Mr. Haman -finalized a loan in the amount of $344,000.00, recording a deed of trust securing said loan on May 1, 1985 (the 13th calendar day from the preliminary decision).
In the meantime, the City Engineer prepared a letter dated April 29, 1985 (the 11th calendar day) advising Mr. Haman that a final decision had been made (attached hereto as Exhibit "B").
However, on April 29, 1985, the City Engineer received an appeal of Mr. Haman's project. On May 1, 1985 (the 13th calendar day) the City Engineer prepared a letter to Mr. Haman notifying him of the appeal (attached hereto as Exhibit "C"), which letter was received by Mr. Haman on May 3, 1985 (the 15th day).
It is our position that, pursuant to the Carlsbad City Code, the appeal was filed late and Mr.Haman-is entitled toa building permit for his project. Therefore, we intend to appear before theCityCouncilunderprotestinordertopreserveanyrights we may have with regard to pursuing-legal remedies to compel the issuance of a building permit in the event that the City Council grants the appeal.
With regard to the merits oftheproject, itshouldbenoted that the proposed project is designed within the parameters of the R-3 zone and the policies of the City at the time the application was filed. The applicant has r-elied upon these policies in filing the application, processing the application, and spending a great deal of time and money in doing so. Based upon the conversation with Staff and -with the neighbors who are now appealing, applicant was of the opinion that the project, as

modified, was acceptable to all parties concerned and has made a commitment for an extremely large loan.
Based upon the facts that applicant has followed all of the procedures to the letter, has fully cooperated with Staff and with the neighbors, and has relied upon the time limits set out by the City, it is respecfully submitted that the project should be approved, as modified. To grant an appeal at this time would not seem to be beneficial to the beach community nor fair to the applicant.

The City has completed a review of the application for a three- unit condominium development located 3376 Garfield.
It is the Land Use Planning Manager's determination that the project is not consistent with the City's condominium regulations (Chapter 21.45) and with all other applicable City ordinances and policies.
This memo, including the listed findings constitutes denial of CP-310.
Findings
1. The project.is not consistent with the intent and purpose of Chapter 21.45 (Planned ,pevelopment Ordinance) of the City's Zoning Code which require that planned development be compatible with surrounding developments.
2. Due to the height of the three-story, 34' high structure, the project is neither compatible nor well-integrated with buildings in the surrounding neighborhood.
3. The project does not meet the guidelines of the General Plan because it does not preserve the neighborhood atmosphere and identity of the existing residential area. Public opinion voiced grave concerns and opposition to a similar project in the near vicinity.

The project involved is described as: a three unit condominium
project.

STATEMENT OF THE MATTER: This project is a minor subdivision
(four units or less), which by subdivision ordinance, does not
require a public hearing. A minor subdivision is processed by
the City staff and must comply with all applicable codes,
regulations, and zoning.
Each property owner may request in writing the opportunity to be
heard on the Tentative Parcel Map. Such written request must be
filed with the City Engineer within fifteen (15) days of this
