RECOMMENDED ACTION:
It is recommended by the Planning Commission that the C:

No. 9'7&&, APPROVING ZC-329.
ITEM EXPLANATION
This is a city initiated request to change the general plan, i
zoning and amend the Agua Hedionda Land Use Plan (AHLUP)
approximately 11 acres located east of 1-5, south of Harri:
Street, and northwest of Hoover Street. The amendments werc
result of the March 19, 1985, City Council meeting, where Counc
denied a zone change and specific plan for the Snug Harbor art
The specific plan would have provided for tourist commercial 1
with a lesser amount of residential use in this area. At tl
meeting, it was the Council's feeling that residential use
more appropriate in this area because of potential traf: impacts and land use incompatibility which could result fi
commercial use. They directed staff to begin proceedings foi
general plan amendment and a zone change to redesignate this a; as residential.
The only remaining issue on these ap2lications is to decide
appropriate residential designation. Staff noticed this item
that two possibilities could be discussed, the RLM ((
du's/acre) and RM (4-10 du's/acre) . The same was done for zon
(R-1-15 or RD-M) . The Planning Commission is recommending the designation and the R-DM zone for the entire 11 acres. They fc
that the RLM category would be difficult economically to develc

The City Council also opened the mandatory 6-week review for
amendment to the AHLUP. The amendments shown on Exhibit 3 woi need to be consistent with the final decision made on the gene:
plan and zoning. For further information please see the attacl

ENVIRONMENTAL REVIEW
This area was subject to full environmental review under
earlier project. The Land Use Planning Manager has issued
statement of Prior Compliance on May 9, 1985.

FISCAL, IMPACT
The elimination of tourist commercial may cause a small rever loss in terms of lost transient occupancy tax. There should
no direct fiscal impact from the proposed change in land use.

I. RECOMMENDATION
It is recommended that the Planning Commission ADOPT Resolutions
2445, 2446, and 2447 recommending APPROVAL of Gm 85-4, ZC-
329 and AHLUP 85-1 per Exhibits 1111', "2" and "3".
11. PROJECT DESCRIPTION
Earlier this year the Planning Commission heard a zone change an
specific plan for the Snug Harbor area which would have provided
for tourist oriented commercial use in conjunction with limited
residential use. The zoning proposed and the specific plan
proposed werean attempt to bring about a compromise between land
owners and surrounding residents who disagreed on the best type
of land use for this area.
At their meeting of March 19, 1985, the City Council denied the applications for a general plan amendment, zone change, and
specific plan for commercial use. At that time they also directed staff to begin proceedings to establish residential USE
in this area. On April 2nd, the Council voted to begin the
mandatory 6-week public review period to amend the Agua Hediondz
Land Use Plan to also reflect residential use for this area.
111. ANALYSIS

Discussion
The proposed general plan amendment would be from RC (Recreation
Commercial) to either RM (Medium) or RLM (0-4 du/ac). Staff has included two residential desingations for the Planning Commissio to consider because either or both may be appropriate,
Residential use is appropriate because the 11 acre area is
surrounded by low-medium density (0-4 du/ac) on the south and southeast, medium-high density (10-20 du/ac) to the north, 1-5 t the west, and the Aqua Hedionda Lagoon to the south. The neares non-residential designation is a commercial center at Tamarack and 1-5.
As stated the site is currently designated RC (Recreational Commercial) on the General Plan. This site was designated RC by
the Coastal Commission and was primarily changed by the City to
comply with coastal standards in the Agua Hedionda Land Use Plan Staff has felt that this site is better suited for residential use designations for several reasons, The property is either
surrounded by residential uses or by physical barriers such as
the lagoon and the freeway. The roads in the immediate area ar not adequate to handle commercial traffic and would be diverting
tourist traffic through existing residential areas, Also this area was designated residential use (RM, 4-10 du/ac) prior to negotiations with the Coastal Commission.
Staff feels that the zoning proposed for the site would be consistent with the General Plan, The RD-P! zone would implement the RM (4-10 du/ac) designations or the R-1-1500 designation would properly implement the RLM category. These zones would probably bring about either moderate density condominiums or apartments, or single family detached homes (PLM, R-1-1500) ,
Staff feels that residential use would be compatible with existing uses in the vicinity. The area to the east and south i basically single family detached housing. The area directly north includes apartments. Although staff feels that either the
RM or the RLM designation is appropriate for the entire area,
staff is recommending that the RM designation be utilized on the property fronting on Harrison Street because it relates more to the RMH area to the north, It would also be more compatible wit the Snug Harbor boating facility, a commercial use at the water' edge, This facility would become a legal non-conforming use and could continue to operate. Staff would recommend that the property fronting on Adams Street be designated RLM because it
relates physically to the single family units to the east (See
Exhibit "1"). The proposed corresponding zoning is shown on
Exhibit "2".
Staff feels that the amendment to the Agua Hedionda Land Use Pla
(AHLUP) is consistent with the proposed general plan amendment and zone change. Exhibit "3" shows the proposed changes to the plan. Basically, all references to commercial use in this area would be removed and replaced with the same residential

categories approved for the general plan and zoning. Followins
adoption by Council, changes to the AHLUP will have to be
considered by the Coastal Conmission.
Staff is recommending approval per Exhibits 111", "2" and "3".

Subject: Comments Regarding Aqua Hedionda Land Use Plan Amendment
(GPA/LU 85-4/ZC - 329/ AHLUP 85-1)
Dear Mr. Holtzmiller:
In response to the notice of public hearing for the above referenced amendment
to the Aqua Hedionda Land Use Plan, we have the following comments.
The area in questions was designated several years ago by both the City and
Coastal Commission for Recreational Commercial use in the Aqua Hedionda Land
Use Plan. This was done in response to Section 30222 of the California
Coastal Act which states:
The use of private lands suitable for visitor-serving commercial
recreational facilities designed to enhance public opportunities
for coastal recreation shall have priority over private residen-
tial, general industrial, or general commercial development, but
not over agriculture or coastal-dependent industry,
The Recreational Commercial designation was considered appropriate for the area
west of the Hoover Street Extension since it allowed for retention of the Snug
Harbor Boat Launch Facility as well as limited expansion of visitor-serving
commercial uses. It is important to recognize that the Coastal Commission did
not indicate that additional boat launch facilities should be permitted; rathe3
that this area represented waterfront property where a variety of visitor-
serving commercial uses were considered appropriate and desirable.

If, based on projected traffic flows, commercial development would overtax
the circulation system (i.e., Adams Street), then it may be appropriate to
reduce the area subject to the Recreational Commercial designation; however,
since the Snug Harbor facility is the only viable public boat launch area on
the lagoon at this time, we believe it inappropriate to designate Snug Harbor
for residential development. Further, unless the traffic figures warrant a
reduction in size of the Recreational Commercial area,we believe the entire Recreational Commercial area west of the Hoover Street Extension should be
retained and that the City has the ability to control the types of commercial
use and their design to insure compatibility with nearby residential uses.
Finally, as you know, in order for the Aqua Hedionda Land Use Plan to remain
certified by the Coastal Commission, the City will need to submit any changes
to the land use designations as an amendment to the Land Use Plan. These
changes would then be reviewed and acted on by the Coastal Commission. There
should be findings and documention which would support the City's position
including traffic data if traffic congestion is one of the reasons for
proposing the change. It should be understood that the staff of the Coastal
Commission is not opposed to changes to the Aqua Hedionda Land Use Plan; but,
if the change involves changing a high priority use (commercial Recreation) to
a lower priority use (Residential) as noted in Section 30222 of the Coastal
Act, then such a change must be justified with appropriate findings and
documentation supplied by the City,
